Research On The Current Situation And Countermeasures Of Jiangsu Land Acquisition Compensation And Resettlement

The rapid development of industrialization and urbanization had an increasingly demands for land.And it has become an inevitable trend for rural collective land to be turned into state-owned land through expropriation.However,farmers have a strong dependence on land because land has been attached to so much importance to earn a living for them.Accordingly,losingland,equivalent to losing source of income,will significantly increase farmers’cost of living which furtherly implies that landless farmers’life may not be guaranteed ever more.Besides,with the growing awareness of farmers’ land rights,it has produced more and more contradictions during land acquisition compensation and resettlement,which aroused widespread concern in society.In order to solve the problem of landless farmers’ living security,simultaneously to alleviate the contradictions and conflicts in the process of land acquisition and compensation,this paper has a research in compensation and resettlement during land expropriation in Jiangsu Province using the method of social survey,comparative analysis,qualitative analysis and quantitative analysis,hoping to provide reference for the reform of land compensation and resettlement system in Jiangsu Province.Firstly,through generalizing the land compensation and resettlement policies of Jiangsu,as well as analyzing the sample data of costs and benefits during land acquisition and transfer,this paper described the status and the existing problemsof land compensation and resettlement policy in Jiangsu Province.We found that the current way of land compensation and resettlement can not guarantee the landless farmers’ to live well enough.In order to find a more rational way of compensation and resettlement in land acquisition,we introduced certain reform of land expropriation compensation and resettlement inside Jiangsu province,with one referred to "reserve land resettlement" in Kunshan City and another referred to "market operation site resettlement policy" in Yixing City,and further summarized the experience and deficiency of the two practices.Simultaneously,we introduced and analyzedthe "reserve land resettlement" in Guangdong Province and Hangzhou city,then compared them with the practices in Kunshan and Yixing.On these bases,it was found that implement of the policies of "reserve land resettlement" in Jiangsu Province had both the necessity and feasibility.Moreover,by summing up the practical experience of other regions,we thought the proportion of reserved land to be the most critical issue in the policy of "reserve land resettlement".Therefore,this paper further proposed a method to calculate reasonable proportionof reserved land,and then used the specific data of Yixing City to calculate the reasonable proportion of reserved land of Yixing.Finally,this paper put forward some policy advice related to land expropriation compensation and resettlement system reform from the perspective of protecting landless farmers’ land rights.Aided with data analysisand comparative case analysis,we draw the following conclusions:Firstly,under the current policy in Jiangsu,the monetary compensation of land acquisition is "not low" compared to the earnings of farmland when cultivated for agricultural use.However,as the farmers’ cost of living increased significantly after land acquisition,their lives are still not guaranteed.The income level that landless farmers can obtain still stands in a low level under social security policy,and their life even can not be guaranteed before they reached retirement age.Secondly,from the comparative analysis of compensation and resettlement practices inside and outside Jiangsu province,the policy of"reserve land resettlement" has an obvious advantage in enabling landless farmers to obtain sustainable benefit and get long-term livelihood security.Thus,the policy of "reserve land resettlement" gets the necessity and feasibility to be introduced into Jiangsu Province.Thirdly,according to the theoretical analysis and practical experience we think the proportion of reserved land is the most critical issue to the policy of "reserve land resettlement".Finally,through our analysis and deduction,the proportion of reserved land in Yixing may be defined to 5%-15%.In the light of our conclusions summarized above,we can see that though land compensation standard repeatedly got raised,and various attempts were madeto reform the mode of land compensation and resettlement in Jiangsu Province,farmers’ land rights were still under damageand landless farmers stillcould notlive a guaranteed life.Therefore,in order to protect landless farmers’ land rights and safeguard their living standard,we propose following policy recommendations:(1)Define "public interest" categoryto narrow the scope of land expropriation.(2)Implement the policy of "reserve land resettlement" to ensure that landless farmers achieve sustained gains.(3)Establish and perfectthe related systems of’reserve land resettlement"policy.
