The Analysis On The Circulation Of Rural Land Management Right In Daye City

In July 2013,president Xi proposed that it is necessary to conduct a thorough study of the relationship among ownership,right of contracting,and right of management for rural land in order to affect substantive rural reform and implement a basic rural management system.Subsequently,a new round of experiments for the rural land system began,and the seventh meeting of the central leading group for deepening reform comprehensively reviewed and passed the pilot reform of rural land expropriation,collective profit-making construction land and homestead land.These actions by the central leading group marked the beginning of land reform.On 30th,October,2016,General office of the central committee of the communist party and the state council general office distributed the guidelines on division method for improving rural land for the property right,right of contracting and marketing right.It separated the land use rights into right of contracting and right of management to parallel property right,right of contracting and management right(hereinafter referred to as three rights),which really meets farmers’ demand for keeping the right of land contracting and marketing the transferred land."Separation of three rights" is an improvement of the basic system of rural operation.It conformed to the law of production relation meeting productivity by focusing on speeding up allowing flexibility of management of the land and optimizing allocation of land resources.It also shows the lasting vitality of basic system of rural operation.It helps to clarify the relation of land property rights to better protect the interests of farmers,contracting farmers and operators and promote the rational utilization of land resources to establish a new type of agricultural management system which allows developing various moderate scale managements to improve the land output,labor productivity and resource utilization.As a result,"Separation of three rights" can lay the system foundation for driving modern agriculture development by guiding the orderly circulation of land management and developing moderate scale agriculture.It has a strong practical meaning to research on rural land circulation under the background of separating the three rights.Economically,farmers can equally get means of production,means of livelihood and means of development,and social security through rural land.Politically,farmers can get democratic power and rights through getting land.It is impossible to get the freedom of living and development under an economical foundation without land,let alone political voice.So land ownership has a close logical relation with political rights in grassroots level democracy structure.Socially,having a good management of the stable and balanced relation in rural land plays an important basic role in stabilizing the rural social class structure and building a harmonious society.The paper uses the Daye county of Hubei province as an example to do in-depth research on selecting the method of land circulation and a performance analysis of the land circulation under the circumstance of separation of the three rights in underdeveloped central hilly land with scattered arable land.And combined with the present policy guidance,it also discusses the inclination of mode selection of land circulation and carefully assesses the economic performance it brings.Here the paper first discusses the present reality and motivations of rural land management right circulation.Then it takes Daye town as an example to discuss the present reality,features and plight of the rural land circulation nowadays.And it use real cases to show the mode of rural land circulation under the present "separation of three rights" and discuss the inclination of mode selection of land circulation and carefully assesses the economic performance it brings.Finally the paper draws a conclusion about it and gives related suggestions accordingly."Separation of three rights" is a product of practical exploration and the fruit of constantly reform and innovation of family contract system trying to meet the demand of economic development.It develops based on the national conditions in our country and focuses on solving the present problems.So it is very creative and has practical proof,and has an important meaning for national policy.In conclusion,we have to manage to deal with any kinds of problems resulting from rural land circulation in cases like Daye county and come up with solutions to them,which helping accomplish the goal of realizing agricultural modernization and building a well-off society.
