Since the reform and opening up in 1978,modernization has been developing in depth,and China is in a critical period of rapid urbanization.At the fourth meeting of the twelfth people's Congress of Shandong Province in 2015,Guo Shuqing,the former governor of the people's Republic of China,put forward the idea of orderly promoting the "Town to Sub-district"."Town to Sub-district" is not only an important measure in the development strategy of new urbanization in China,but also an important part of the adjustment of administrative divisions."Town to Sub-district" land circulation problem under the background of "directly related to the success of the construction of the town to the street",is the new rural construction and urbanization construction is the origin of the contradiction,reasonable and perfect the land transfer mechanism will promote the development of the town to the street ",promoting the construction of new rural construction and urbanization in China.To promote the coordinated development of urban and rural areas.The circulation of rural land under the background of "Town to Sub-district" has its own unique characteristics.It is not only reflected in the fact that its economic value is higher than that of other regions,but also because of the unclear ownership of land after the "reformation of the streets" in the light of the current laws,regulations and policies.On the other hand,people involved in the transfer of rural land in the context of "town-to-street reform" have a higher appetite for a better life.If they can not satisfy their economic interests,they will have far-reaching social problems.Based on this,the transfer of rural land under the background of "Town to Sub-district" has important theoretical and practical significance.The circulation of rural land under the background of "Town to Sub-district" mainly involves the transfer of land contract management rights,transfer of rural collective construction land circulation use right,transfer of homestead land use right.The transfer of land contractual management rights has an uimmediate bearing oil the vital interests of the vast majority of peasants;the circulation of land for collective construction is the key to solving the problem of urbanized land use by "Town to Sub-district";transfer of homestead land use right involves the housing problems of villagers after "Town to Sub-district".Solve the transfer of the above three types of land use rights in order to truly achieve "Town to Sub-district"?This article from the main problems of Town to Sub-district existing in the rural land circulation in the background as the starting point,especially land ownership problems,combined with the F County Town to Sub-district village land transfer practice experience,the new situation and solve the "Town to Sub-district"rural land circulation problem in an effective way.To provide reference for rural land circulation under the background of "Town to Sub-district",and to promote social harmony.This article consists of six chapters.The first chapter is the introduction of this article.Explain the background and siugnificance of this topic;summarize the research results and literature at home and abroad;explain the research content,ideas and methods;introduce the three innovations of this article.The second chapter is the introduction of the concept of the article research theme,clarifying what is "Town to Sub-district",what is the rural land circulation,and connotation of the subordinate concepts of the two main concepts.The third chapter reviews and combs the development process of "Town to Sub-district"and land circulation in China,discusses the relationship between the two and points out the problems in rural land circulation under the background of "Town to Sub-district".Focus on the legal point of view to explore whether the land is owned by the state or to maintain the collective ownership of this key issue.According to the Notice on Actively Steadily Promoting the Reform of Household Registration Management System promulgated by the State Council in 2011,this issue is clarified:the reform of the household registration system is forbidden or unauthorized adoption of such methods as "reforming the streets" and "revising the villages" expropriation,circulation procedures will be collectively owned land peasants into state-owned land.The fourth chapter is an example analysis,taking F county as the research object,analyzing its practice,effectiveness and existing problems in the process of rural collective property rights system reform.The fifth chapter is the part of this article to solve the problem.Discusses the realization of rural land circulation and "Town to Sub-district" coordinated development of the basic ideas and specific measures.The sixth chapter is the conclusion and prospect of this article.On the basis of summarizing the main research work of the full text,this paper draws the conclusion of the research,and on this basis sums up the shortcomings of this study and the problems to be further studied.
