Since the 21 st century,Various parts of the country have appeared the phenomenon of limited property houses in the name of such as reconstruction of the urban village、balance urban and rural development、new rural construction and so on.The study found that limited property houses have features as follows: large number,widely distributed,trading illegally,disputes and complex rights.At present,limited property houses has developed into a highly focused issue by the community.In fact,since1999,the Chinese government has repeatedly stressed the illegality transactions of limited property houses,banned the development and sale of the limited property houses.But from the practical point of view,these decrees have little effect.Our academe have already arise a extensive research on the problems of the limited property houses,but objectively speaking and for now,we still have no scientific consensus on the key problems such as the system root,the economic essence,the way of disposal of the small right house.In this paper,we use the well-known database resources of CNKI,Spring link and other well-known database resources at home and abroad to collect rich literature,and in accordance with the economics,political science,law,sociology and other subject background,the limited property houses’ literature systematically have been sort out.This paper analyzes the origin of the land system formed by the limited property houses,analyzes the economic essence of the different types of limited property houses and creates the conditions for solving the problem of limited property houses.The main conclusions of this study are as follows:Firstly,the origin of limited property houses is the dual system of land;its economic essence is peasant collective hunt the added-value of the land.The central government controls the transfer of state-owned land and collective land agricultural land in space and time through the multiple means such as the overall plan for land utilization and the annual land use plan.Local governments and peasants collectively act as monopolies for the monopoly of land supply;state-owned land and peasant collective land in two relatively independent primary markets to complete the transaction.Local governments use the existing legal system,after the collective land acquisition and expropriation of farmers,possession of a large proportion of land premium value-added income;limited property houses formation is after the peasant collective land autonomy occurred in the "market jump".Secondly,through game analysis can be seen,under the current policy system arrangement,it is the best strategy for local governments to prohibit the development and construction of limited property houses;For farmers or peasants,it is an optimal strategy to choose and develop limited property houses.Practice shows that the farmers excluded from the ranks of urbanization in the sharing of results,the development ideas through land acquisition and expropriation to obtain value-added income have been unsustainable.Thirdly,In the long run,the fundamental way to solve the problem of limited property houses is to reform the land acquisition system,allow the peasant collective land into the market,and adjust the distribution of the value-added income of the land in different subjects through taxation.In the short term,the difficulty in solving the problem of limited property houses is how to put forward some reform proposals which are both forward-looking and operational in practice and can be accepted by the current stakeholders in the background of this fast-growing era.For reformers,it is important to note that the distribution of premiums is motivating those who are truly able to create value rather than encouraging those who are highly concerned about the value-added benefits. |
