The basic old-age insurance system is based on the laws and regulations stipulated by the state to ensure that workers reach the retirement age,the state designated by the fruits of labor to maintain the most basic life,and thus the establishment of social security system.The ultimate goal of basic old-age insurance is to social security as a means to protect the basic needs of the elderly,to provide a stable and reliable source of livelihood,which is about the people's livelihood and social stability important things.China promulgated the "Social Insurance Law of the People's Republic of China","Labor Law" and other related laws aimed at better safeguarding the interests of the majority of citizens."Social Insurance Law" in 2010,and with the beginning of 2011,and the basic old-age insurance workers in Chapter ? of the Act provides that the provisions of the insured population,insurance conditions,payment and other relevant information,but also to the The legal basis of the basic old-age insurance.As a social policy closely related to reality,the endowment insurance is the support of social practice and the guidance of theory,so the theory and practice are complementary.The development of the old-age insurance in our country is inseparable from the social status quo,But also inseparable from the theory of social reality of thinking and guidance.However,although the research on the basic endowment insurance has been developed and improved in China,there is no holistic analysis.The basic research on the basic old-age insurance system has been less studied in a certain aspect of the basic old-age insurance system.This paper will introduce the basic theory of the basic old-age insurance system,draw lessons from the successful experience of foreign countries,and discuss the main problems and inherent inducements of the basic old-age insurance system in our country,construct the policy framework of multi-level old-age insurance system,To provide a theoretical reference for the establishment of basic social pension insurance system for workers in line with China's national conditions.A set of scientific basic old-age insurance system,need our country law to give full play to their role,the only way to solve the basic old-age insurance on the management and operation of the problem.For these,although the social and academic discussions continue,but the problem has not been very effective solution.At the same time,how to establish a set of sound old-age insurance system is an important component of the implementation of China's social security system.Therefore,as an important member of social security,the pension will be more attention and concern by the government.From the practical value,the basic old-age insurance for workers rely on the country's strong economic strength and wealth accumulation,through the national fiscal income redistribution means can basically protect the basic living of the elderly or even a higher level of life,promote the stability of modern economic benefits And growth,if the basic old-age insurance can not effectively solve the problem of old-age pension,it will inevitably lead to social problems,it will be difficult to achieve the whole socio-economic development,so the basic endowment insurance research is also necessary.Based on the "Social Insurance Law" and "Pension Insurance Management Regulations" and other relevant laws and regulations,this paper explores and analyzes the basic old-age insurance system of employees from four parts:The first part is an overview of the basic old-age insurance for employees,Partly introduces the concept and characteristics of the system,then compares the basic endowment insurance system with the supplementary old-age insurance system,then introduces and cognizes it through the theoretical foundation of the world historical development endowment insurance,and concludes the basic endowment insurance For the role of society.The second part is to introduce the basic old-age insurance of employees and point out the shortcomings of the system.This paper introduces the two aspects of pension fund raising and treatment,and then analyzes the five deficiencies of the basic old-age insurance of employees,including the "social insurance law" and "old-age insurance management regulations" and other relevant laws and regulations.Such as the lack of fairness,the low level of insurance co-ordination,the disequilibrium of fund balance,the interruption of insurance,and the difficulties of the implementation of the merger of government and public institutions,the paper discusses these problems and causes.The third part is to examine the basic pension insurance system and law of the countries and regions and its enlightenment to our country.This part mainly introduces the legislation of the old-age insurance system in the United States,Sweden,Singapore and Germany,and sums up the experience and inspiration which we should learn from.The fourth part is the focus of this paper,put forward to improve the basic old-age insurance system.Mainly from improving the basic pension insurance system for employees to ease the imbalance in pension insurance income and expenditure,after the merger of institutions for the implementation of the pension difficult measures to improve the overall level of China's pension insurance and solve the security measures.Based on the current situation of legislation in China,this paper uses historical analysis,comparative analysis and other research methods to interpret and analyze the basic old-age insurance system of our country's workers.Combining theory with practice,we can draw lessons from relevant countries.Experience,on the basis of summing up the proposed system to improve the concept of the establishment of a sound basic pension insurance system to provide a valuable reference.
