| Parole is a kind of penalty execution system.It can not be replaced by encouraging criminals to transform,to promote the socialization of criminals,to save the cost of execution,to maintain the order of supervision and to build a harmonious society.The parole system of our country runs well in general,but with the rapid economic and social development,as an important aspect of social management,the penalty execution and parole system also has a lot of new situations and new problems.It is closely related to the society to accept the punishment and reform of criminals,to be punished or to be released on parole,or to commit crimes during the period of parole.The reform and perfection of parole system is an important part of the reform of the central judicial system and the work mechanism in recent years.Choice of parole system as a research topic has the value and significance of theoretical exploration and face to the reality.This thesis is divided into four parts to analyze the parole system of our country.The first part is an overview of the parole system.This part briefly introduces the meaning of parole and the process of its development,and summarizes the theoretical basis and function of its existence.The second part is comparative study on parole system.Using the method of comparative analysis,this part introduces the system of parole system in the two legal systems of the world.This part has carried on the comparative study to the parole system of several major countries and regions,including France,Japan,Britain,the United States and Taiwan area of our country.The third part is current situation and existing problems of parole system in China.This part through the method of empirical research,combined with practice,select the different areas for investigation,and strive to objectively show the status quo of the operation of the parole system in china.This part adopts the method of statistical data analysis,statistical data from authoritative to the Supreme People’s court and the Ministry of Justice Bureau of prisons,carries on the analysis to explain and demonstrate the existing problems and the reasons behind the deep in the graph display and comprehensive description of the way.The fourth part is the focus of this paper,mainly puts forward some suggestions to improve the parole system of our country.Mainly have: no parole shall be amended;establish legal parole system;to refine the risk of no re crime;increase the flow of people,Hong Kong,Macao and Taiwan area of our country,foreign criminals parole provisions;the implementation of parole margin(person)system;full implementation of parole system;the establishment of parole board;the introduction of restorative justice philosophy;perfecting the system of community correction;promote parole hearing;etc.. |
