Research And Reflection On The Risk Assessment Of Reoffending On The Parole System

Parole is a penalty executive policy emphasising on realization of penalty goal and carrying on penalty effects,which is widely used all over the world for its effects and efficiency.However,usage of parole in China is kept on a relatively low level comparing to forgein countries;and in our legel practice,parole is far less used than commutation.It’s a pity that unbalanced use of parole makes a low performance of its functions and effects.In the studies for the reasons of low usage of parole,how to decide "risk-free of reoffending"becomes the focus.According to this,it becomes an unavoidable topic that how to establish an estimation for the risk of reoffending for paroled criminals.Base on the studies for parole risk and reoffending prediction,the estimation for the risk of reoffending for paroled criminals is built on mordern relative technique.Chance of reoffending is predicted using a relative factor. It has unique ways for measuring and studying,which is widely used and covers many fields.lt scientifically predicts chance of reoffending and excludes the arbitrariness and subjectivity in usage of parole to the most extent. This article tries to make a theoritical analyse for the aspects of theoritical basis,measurability,risk resourses,estimating projects and estimating techiques of risk assessment of reoffending for parole criminals,which hopefully man benefit the increasing usage of parole in China.In this article,relative legel problems about risk assessment of reoffending for parole criminals are analysed discussed,using methods of cases analyze and legislation comparation.It’s divided into5parts.Part1.Introduction.Reasons for the very low usage of parole in China are tracked in concepts of penalty execution and legel practice.Questions and objects are brought forword,and relative articles and research are listed,to establish the starting point of this article.Part2.Risk of reoffending for paroled criminals and risk assessment.Risk of reoffending for paroled criminals is analyzed and its relationship with risk assessment is brought forword,and conclusion can be made that as a manage method.The ideal effects of risk assessment are listed,which reflect the process of scientifically using of the estimation.Part3.Basic factors of risk of reoffending for paroled criminals.This part tries to analyze the subjective and objective factors affecting reoffending and differs inner and outer reasons.It emphasis on the-study for personal dangerousness of paroled criminals,and analyzes theoritical basis and contents of personal dangerousness,which settles foundation for Risk assessment of reoffending in the next.Part4.Standard of risk assessment of reoffending for paroled criminals.Risk resources of reoffending for paroled criminals is settled as a starting point,from where deep reasons cause,reoffending and discussed,and estimating projects are analyzed from personal and social levels.Finally,estimating techiques are conclued in sociology,psychology and management.Conclusion.Suggestions for effects and managability of risk assessment in parole are brought forword.It’s pointed out that although the institution and process about parole are reasonable,reliability and efficiency of Risk-estimation must be guaranteed to use parole.It is suggested that relative actions and processes should be manged by special institution,and individual case track and responsibility system should be realized.
