To Discuss Execution System Of Parole And Its Perfection In China

Researches on parole at present mainly concentrated on the problems of parole application in criminal law theorists and judicial practice,especially on the conditions for parole.And there are few researches on parole enforcement.But Injudicial practice,cases of parole are more focused on enforcement of parole system.From the point of legislation,laws and regulations system of parole enforcement now are comparatively scattered and lack of pertinence.Although corresponding regulations were unveiled by Supreme Judicial Court and Supreme Procuratorate,there were still many problems which affects parole enforcement directly,such as lack of standard and operability,or too principle on regulations Based on practical work,we study the problems of parole enforcement system in three parts.In the first part,we should clarify the conception,value and connotation of parole enforcement system.Parole Enforcement,which means the process from petition to community correction,including parole petition,parole judgement,parole implementation and parole supervision.These four parts make an organic unity.In the second part,Through empirical methods,we should analyze such problems in current legislation and practice.In the third part,we should propose concrete assumptions on the improvement of parole enforcement system,based on constructing cohesion systems between scoring assessment and parole petition,and improving the mode of supervision and reform.And tried to form a legislative rudiment of“criminal execution law,.And our parole enforcement system should be improved in legislation,petition system,and supervision system.And then parole enforcement will present more fairness,justice and publicity.And it also helps to maintain judicial justice,and promote judicial public faith force.
