Research On The Problem Of Theory And Practice Of The Parole System

The parole system, which originated from Europe in 18th century, is the product of latter-day capitalist countries'penalty system and prison penalty execution system. In the west, it takes root to the retribution theory and the goal punishment theory. While in China, it continues to absorb the nutrition of the theory of education and the theory of penalty individually. It not only realizes the penal polity of combing the punishment and reformation, but also plays an active role in inspiring with the reformation of criminal, remedying the difference of sentence, promoting the criminals're-socialization and carrying out the economical penalty. However, our parole system has many problems in theory and practice presently, which has badly influenced its function and the goal of the penalty. This thesis begins with inquiring into the concept and origination of the parole system and then clarify it theory and function. Basing on uniting the practice intensively, this thesis goes deep into the problems of legislation and judicial practice of the parole system. Finally, it puts forward some perfecting suggestions and reforming measures.
