Research On The Improvement Of Animal Protection Legislation In China

Now with the popularization and development of network,more and more animal cruelty has been exposed for years.Animal protection has increased to the point where the conflict has been persistently on the rise between people and animals.Because of the deficiency of legislation in animal protection,the contradiction cannot be solved between humans and animals.Although animal cruelty draws strong condemnation from people,the moral condemnation is too limited to forbid the animal cruelty.To protect animals by the law is an effective way to resolve conflicts between people and animals.It is beneficial to conduct the animal protection legislation on the mainland.Through legislation to achieve animal welfare is the most effective way.It is effective for protecting animal's life,upholding animal dignity and developing human being spirit.It reflects the ethic sentiment of the citizens and personal qualities.Besides,it has great effect for maintaining the sustainable development of environment and preserving biological diversity.Therefore,a harmonious relationship between human and nature can be true.It is worth mentioning that it can promote standard of animal welfare,regulate the order of export business and encourage the development of national trade.A good international image also can be created.The unified national legal animal protection of animals is relatively backward so far.It reflects the following points.Firstly,legislative intent takes animal protection into account and doesn't care interests of animals.Secondly,legal system is loose.Thirdly,the power of legal sanction for animal cruelty is insufficient.The lastly,public participation system in legislation is inadequacy.The legislation of animal conversation in Taiwan has been more than a decade.Therefore,it has comparatively matured experiences in this area.And in pace with gradual improvement of the protection system for animals,it has accumulated some experience in legislation and practice.It is available for reference because our mainland and Taiwan have the same cultural and social background.Therefore,it is necessary to use Taiwan's legislative experience as reference.It is conductive for making efforts of animal protection legislation on the mainland region.Aiming at the existing problems of our animal protection legislation,this paper attempts to solve the problems in the following ways.Firstly,we should convert the legislative purpose of animal protection.Secondly,it is necessary for setting the legal system reasonably.Thirdly,we should set up strict legal liability.The lastly,we should perfect the public participation system.One of the most significant things is making special laws to resolve conflicts between people and animals.Furthermore,this paper pays attention to a clear direction of animal protection legislation.Let us to make effort to keep animals alive on the world with dignity and realize harmonious development between people and animals.
