A Research On Animal Welfare Legislation Of China

The term "welfare" in modern Chinese dictionary is the meaning of healthy and comfortable living conditions. "Animal welfare"refers to the rights of animals. Since the 19th century British anti-cruelty to animals bill——"Martin Act " began, animal welfare legislation gradually tend tobe a legislation of worldwide. With the development of animal welfare legislation in the international world, increasingly sophisticated animal welfare legal systems have emerged, however,China is still a blank in this area. In recent years, there have been growing number of incidents of cruelty to animals in China, even turn into obstacles to export animal products abroad ,besides, animal epidemics occurred frequently these days, all of these should make us ponder the underlying reasons——animal welfare legislation has not been set up, can be said that the root of it all . Research on the legal system for animal welfare, its purpose is to expedite the legal system of animal welfare legislative process in our country, put the animals under the comprehensive protection. Its significance lies in the improvement of animal welfare legislation in order to improve China's international status and reputation, promote the export of animal products trade,and implement the construction of a harmonious society in China. This article is divided into four parts, the first part is discussed for the general theory of artical, including the most basic definition, the classification of animals, the origin and development of animal welfare legislation; the second part focuses on the necessary and feasibility about animal welfare legislation in China; The third section discusses animal welfare legislation in a comparative study among European Union, the United States and China; the fourth part is the core of this paper, from animal recognized legal status, legislative principles, concepts and other specific measures are described.
