Research On The Implementation Of Food Safety Liability Insurance In Henan Province

As the saying goes:“Hunger breeds discontentment to food safety for the first.” Food security is not only closely related to people's life, but also the basis of their participation in other social activities, which is directly related to the social harmony and stability. Therefore, food safety issues have long been the focus of the whole society. In recent years, with the occurrence of a series of safety accidents, such as “Sanlu Melamine”,“Shuanghui Clenbuterol” and “Alcoholic liquor excessive plasticizer”, the degree of public attention to food safety issues has been raised to a new height. The frequent occurrence of food safety incidents not only arouse public's concern on food safety, but also stimulate the food companies' demand for food safety liability insurance. With the latest revision of the Food Safety Law :“The state encourages food enterprises to participate in food safety liability insurance” and the policy support of Henan Province: “The government explores the development of food safety liability insurance pilot”, the implementation of the insurance has been made remarkable achievements. However, through the Grey correlation analysis of the liability insurance, we know that as a fledgling and imperfect insurance, it's facing lots of problems, such as imperfect laws and regulations, poor supervision, lack of policy support, unscientific product, unprofessional level, low insurance initiative,legal and moral consciousness, poor rights awareness and so on.On the basis of domestic and foreign relevant literature, we comb the practice of the United States,EU,Japan,Taiwan and regions within Zhejiang, Hunan how to carry out food safety liability insurance, and from which we sum up the experience to how to implement the insurance in Henan Province.Through the research and discussion, we know that to implement food safety liability insurance smoothly in Henan Province, we need take action in the following four areas: firstly, the government should improve the relevant laws and regulations,strengthen the construction of supervision mechanism,increase policy support and select the operating mode which is suitable for the actual situation in Henan Province; secondly, the insurance company should not only design scientific insurance products, but also improve their professional level; then, food companies should enhance their awareness of the insurance, while strengthening self-regulation; finally, consumers need to constantly raise the rights awareness and safety awareness.
