The Research On State Power Respond To Network Of Public Opinion

With the emergence and development of Internet technology,the virtual space different from and independent of real society has been gradually forming,somore and more people express their opinion cannot express it in real society in many different ways in this space.With the enlargement of the right of expression in cyberspace, the enlargement is combined with the traditional public opinion,producing a new public opinion form different from traditional form-network of public opinion.And it often can produce more pressure than traditional form to monitor state power and make it come back to the way of public interest purpose,causing the attention of state power on it.The result is the penetration into network by state power,and the most significant feature of this result is reflected on regulation of speech by state power,transferring the "gatekeeper"function from offline to online.Thus the transformation provides opportunity for dialogue between network of public opinion and state power,in the process of interaction,how to respond to the network of public opinion belongs to scope of private right and how to function when facing with reasonable requests from private right become the focus of studies.The paper, "Lei Yang event" as the starting point,is divided into three stages roughly in accordance with the order of time : the first stage is that Shanyangyue published an article titled "Just Be a Father who Got Master Degree from Renmin University of China ,Why was he strangely dead ? ",arousing the first wave of public opinion ; the second stage is that the major news media and experts and scholars played role of"opinion leader" guided Internet users to take a rational conversation with state power;the third stage is that the Procuratorial organs interfered in the event under the pressure of network of public opinion?Through academic perspective,this paper put the emphasis on objective facts and theoretical discussion,finally draw the conclusion by observing interaction between network of public opinion and state power in these three stages.First of all,it is the police,as the symbol of state,that struggle for the voice with the internet users,gradually forming public issues aimed at attracting state power's attention in the process of discourse competition,taking it into agenda scope,and finally set up the public agenda according to content of public opinion concerned.The procuratorial organs,as internal power of state power,finally entered public view to correct police power under the auspices of public agenda in response to public doubts about state power in the first stage.At last,the theme extend form the event itself to the issue about control of information resources by state power and the limit is not to interfere with expressive right,and then extended to the issue on whether possible existence of populist tendencies which formed the network of public opinion in this virtual space has a positive effect on state power or not,and finally concluded that: the relationship between network of public opinion,as a product of citizens' expressive behavior,and state power in essence is the interaction of private right and state power,and in this interactive relationship,the network of public opinion just functioned as conduction mechanism on state power through transforming the pressure from external to internal,correcting the deviation from the orbit state power,because the network of public opinion itself cannot correct deviation of state power,just as a pressure sensing device trigger state power internal correction.Reflecting on "Lei Yang Event",it is the network of public opinion that transformed pressure to procuratorial organs,then the procuratorial place the event in legal proceedings and accept the public scrutiny, and investigate relevant person responsible for the event to respond to the demand for truth of network of public opinion with legal autopsy results.
