| With the popularity of Microblog,WeChat and other social applications, China began to enter the We-media age.We media changed the top-down mode of propagation which traditional media used,breaking the "information gap" between the public and the mass media in the past.It provides an open platform for ordinary people to speak freely.On this platform,everyone has the dual role of communicators and audiences,free to participate in the discussion of social issues.The popularization and development of We media not only changed the way of thinking and living,but also bring public opinion together,forming a powerful force.This force has now penetrated into the judicial process, particularly to the criminal trial.While promoting a fair and public criminal trial,on the other hand,Some adverse public opinion undermined judicial independence and fairness.How to achieve a balance between the We-media and criminal justice.This article to analyze: firstly, introducing the background, purpose, significance and main problems of this study. The second part is about the connotations of We-media and criminal justice,by generalizing main ways of the We media to supervise criminal trial, like the Crowd effect of Microblog, Microblog live criminal trial,the public platform of Wechat, the platform of lawyers’ We-media. The third part is about the impact of We-media supervision on criminal trial, positive impacts like increasing the transparency of the trial proceedings, promoting individual justice, exposuring the lag in legislation, negative impacts like "Opinion Judgment",internet rumors and violence.The fourth part is about Causes of conflict between We media and criminal trial.The essence is two values conflict between "freedom of speech" and "judicial independence". Specific reasons involving social environment, the judiciary, probloms of the We-media and public psychology etc. The fifth part is about suggestions to achieve a balance between the We-meida supervision and criminal trial,involving using the We-Meida to respond to public opinion and guide it timely, insisting on Judicial Independence, implementing of network real name, improving self-discipline and supervision of We-meida and so on.Through the above research, it concluded: the arrival of the era of We-media is both an opportunity and a challenge for criminal trial. On the one hand, the judiciary should "hug" the We-media with an enthusiastic attitude,on the other hand,it should to hold the bottom line of Judicial Independence, treating public opinion rationally,and guiding it timely. Only to reach a balance between the two, in order to make good use of We-media which is a double-edged sword, thereby promoting judicial fairness. |
