Research On The Legalization Of College Studen T Affairs Administration Under The Comprehensive Rule Of Law

The 15th National Congress of the Communist Party of China put forward the idea that all affairs of the state,the work must be carried out in accordance with the provisions of laws and regulations.The 18th National Congress of the Communist Party of China further put forward the strategy of comprehensively promoting the rule of law.College Student Affairs Administration is the management by colleges of all things in addition to academic affairs that students are involved in.It’s one of the important links in the management of Higher Education.The core of Student Affairs Administration is to provide services for students’ studies and All-round development.In the context of the Rule byLaw,Student Affairs Administration must be carried out in accordance with law,as well as emphasize the rights of the standard and solve the problems or divergence in the work accordance with laws and regulations.Colleges should respect and guarantee the rights of college students and construct the Legal System of Student Affairs Administration in colleges and universities.At present,China’s colleges and universities have made certain achievements in constructing the Legalization of College Student Affairs Administration.China has initially established the College Student Affairs Administration related education laws and regulations system.The idea of "Manage the school by law" is also gradually accepted in colleges and universities.However,there are problems hidden behind the achievements,for instance there are still conflicts between colleges’ Management Rights and Students’ Rights in many aspects,also college students’ remedy is not smooth,college managers’ awareness of the Rule by Law as well as educational laws and regulations still needs to be improved.By using literature analysis,induction analysis,case analysis and other research methods,this paper makes a systematic research on the construction of the Legalization of College Student Affairs Administration in the context of a comprehensive rule of law Firstly,it defines the basic category of the comprehensive rule of law and the Legalization of College Student Affairs Administration.The overall goal of comprehensively promoting the rule of law is to build a socialist system of rule by law with Chinese characteristics and build a socialist country under the rule of law.The Legalization of College Student Affairs Administration requires colleges and universities to uphold the rule of law and establish the rules and regulations system according to law,standardize management behavior and improve the relief.One of the points of the Legalization of College Student Affairs Administration is to protect the rights of college students by clarifying the legal relationship between colleges and students and clearing the management authority of colleges and universities.Secondly,it discusses the content and significance of the Legalization of College Student Affairs Administration in the context of a comprehensive rule of law.To carry out Student Affairs Administration according to law colleges should adhere to the principle of Rights-based and principle of legal priority and principle of due process,and implement the requirements of the Rule by Law from the concept,mechanism,model and other aspects.In the context of the rule of law the Legalization of College Student Affairs Administration has important practical significance from the country,society,school and personal level.Thirdly,it reviews the historical evolution of the construction of the Legalization of College Student Affairs Administration and summarizes the different characteristics of each stage in the protection of student rights,the construction of legal system and the management mode.On the basis of this division this part summarizes the achievements in the process of the Legalization of Student Affairs Administration in colleges.Fourthly,this paper analysis the problems and causes of the current Student Affairs Administration by combining with the judicial jurisprudence and the work practice in recent years.This paper summarizes the problems as the conflict between the Management Rights of colleges and the Rights of college students.The conflict is manifested in three aspects:conflict between the Management Right of university and the Personal Rights of Students,conflict between the Management Right of university and the Property Rights of Students,conflict between the Management Right of university and the Higher Education Rights of Students.The causes for the conflicts are the lag of the idea of Rule by law of both the subject and the object in College Student Affairs Administration.the Legal System of Student Affairs Administration is imperfect,the procedure of Student Affairs Administrations improperly,the way to relieve college students’ rights is not smooth,the level of specialization of Student Affairs Administration team is low.Finally,according to the causes of the problems,constructs the Legalization system of College Student Affairs Administration from the perspective of comprehensive rule of law from five aspects:Ideas system,Legal system,Behavioral norms system,Rights relief system,Team building system.
