Research On Politics And Legislation Restriction Mechanism In The Quality Assurance Of Higher Education

Since the end of last century, higher education quality assurance movement in the rise of world-wide, how to guarantee and improve the quality of domestic higher education has became an important topic for the work of the government. In our country, the development of market economy and the progress of the society are pressing for the government to clarify responsibility, through the constraints of political science and law for guidance, prevention and correction of higher education, to promote the further perfect of higher education quality assurance system. In the process of the assurance of higher education, the government mainly constraints through 1 egislative, administrative and many other methods.At present, in academia the research in this a rea is numerous and scattered, even the research of restraint mechanism and law system is more scarcer. So it is necessary to research constraint mechanism of politics and law systematically, enhance the level of the government on assuring the quality of higher education. Constraint mechanism is that through the constraints of political science and law of the government to assure the quality of higher education process effectively, hence leading to the implementation of its functions, the structure and operation principle. In recent years about the government acts to ensure the quality of higher education, experts and scholars research toward diversified development. They have done a widely discussion and in-depth research on the government's behavior of political science and law, then they discovered some problems about it. Therefore, this paper study the government responsibility theory and system control theory as the foundation. We will improve the assurance constraint mechanism in input mechanism, process and output mechanism of political science and law of the three aspects. Input mechanism is an important component of the constraint mechanism of politics and law, it is the precondition for the government to assure the quality of higher education activities. The constraint mechanism of input mechanism of politics and law still exists for examination and approval procedure complex, macro planning not scientific and single issues such as quality standardization. So, we should improve legislation, create good power foundation, optimize the administrative examination and approval procedures, improve the macro planning and promote the diversified development of quality standards. Process mechanism is the main mechanism, constraint mechanism of politics and law aims to enter the policies and regulations through policy guidance, the legal system of supervision and administrative regulation such as real-time operation in order to assure the quality of the higher education purpose. But it has some deficiencies too. It would be policy guidance purpose dislocation, weakness of legal supervision and execution as well as administrative regulation subject vacancy and so on. Therefore, we should clear policy guidance to strengthen legal supervision to carry out the aspects such as government administrative mediation function improvement. Output mechanism is also an important part of the constraint mechanism of politics and law, it ensure the quality of higher education and input to the government policies and regulations and other activities for feedback and evaluation. Output mechanism has the following problems as well, the effect of feedback channel, quality assessment is "government failure", the lack of scientific layout structure, etc. We will improve the mechanism of the output from the following aspects:establishing evaluation feedback system and intermediary organization structure adjustment, optimization of layout.
