Research On Administrative Regulation Of The Webcast

Webcast is based on the Internet technology to present the audience with the scene information such as pictures,audio,video and other events.It can meet the two basic properties of "instant" and "interaction".Compared with other traditional media forms(such as live TV),webcast has three unique characteristics: Mobile,platform and community-based.In recent years,since the rise of live webcast from the traditional show live,it has undergone three updates until the fourth generation of VR live broadcast.However,there are some limitations in the existing network broadcast of criminal law system,civil law system,market economic system guidance and moral standard effect.The flexibility of political law and the extensiveness of its adjustment range determine that it can make up for the shortcomings of the above regulation and guidance in the process of dealing with the development of network live.Therefore,it is necessary to intervene the administrative power to regulate the webcast.However,there are also some deficiencies in the present administrative regulation of webcast.Firstly,the existing network direct seeding legislation is dispersed,the regulation main body is ambiguous,and lacks a specialized network direct seeding law.Secondly,the administrative regulation subject in the regulation process of its unclear positioning also to a certain extent,restricting the development of the webcast.Thirdly,the administrative regulation means is unitary,and mainly by means of compulsory regulation,such as administrative license and administrative punishment.Finally,the supervision system of the network is not complete,which leads to the lack of coordination and co-ordination between the supervision of administrative regulation and self-regulation.According to the characteristics of the network direct seeding,the author points out the problems existing in the current network direct broadcast administrative regulation,and its perfecting way should include the following aspects.Firstly,to set up a dedicated network of legislation to the Basic Law,the supervision of its hierarchical classification,and clear the standards of regulatory content.Secondly,the main functions of guiding,service,macro-regulation and process supervision should be strengthened,not only in the single supervision function,but on the reasonable limits and basis of the existing coercive,control,microcosmic regulation and preventive punishment.Thirdly,the way of optimizing the administrative regulation of the network live broadcast,on the basis of the traditional rigid administrative regulation means,introduce the flexible regulation way of administrative guidance,administrative reward,administrative interview and so on.Finally,we should improve the supervision system of the network live broadcast,change the administrative supervision mode actively,perfect the self-discipline mechanism of the network direct seeding industry.
