Research On Administrative Regulation Of The Webcast

As a new industry and social phenomenon,webcast brings various problems while promoting social and economic development and enriching social and cultural life.The essence of its administrative regulation is to restrict citizens' freedom of expression and economic activities.Nowadays,the frequent chaos in the webcast industry not only shows the ineffectiveness of the traditional regulation model,but also causes problems such as unclear authority of the management subject,the abolition of administrative procedure and the absence of substantive justice in the regulation process.This requires that there must be a system for the administrative regulation of webcast.To explore the system of administrative regulation in the context of the rule of law in China,we must start from the perspective of administrative rule of law.As the basic principle and realistic requirement of modern administrative law,the rule of administrative law requires that the administrative regulation of webcast must be based on the law,conform to the law and take action to ensure the implementation of legal norms,so as to avoid the consequences of "defending the people".Traditional administrative behavior regulation,such as administrative permission and administrative penalty,shows decadence in the face of the characteristics of webcast,such as large participation base,instantaneity,personality segmentation,etc.Therefore,the lack of effectiveness also puts forward urgent requirements for the administrative regulation of webcast.From the point of view of service-oriented government,the regulation of industry can be changed from passive confrontation mode to active cooperation mode.On the basis of the fact that administrative factual acts play an increasingly important role in the process of participating in administrative regulation,introducing such regulation modes as administrative guidance and administrative interview,which are widely used at present,to a certain extent,the relative person of administrative regulation can be obtained.Voluntary cooperation can achieve very good results for the improvement of administrative efficiency and the savings ofadministrative costs.If we take the initiative to cater to the industry and carry out "government + live broadcasting",we can not only innovate the traditional administrative means,but also be more conducive to promoting the healthy development of the online live broadcasting industry.From the point of view of limited government,the government "delegates power" to the industry self-governing organizations for self-governing management,which can make the industry self-governing organizations carry out professional and efficient management for the characteristics of live network broadcasting.It not only avoids excessive waste of administrative resources,but also meets the inevitable requirements of "limited government".
