Research On The Legal Regulation Of Juveniles’ Reward Behavior In Webcast

With the widespread use of smart devices and electronic payment methods,disputes caused by minors recharging and rewarding anchors in live web-casts are not uncommon.Webcast transcends time and space constraints,and is extremely attractive to online users.Due to the low entry barriers of current web-casting platforms,the absence of laws related to online consumption of minors,the overlapping supervision functions of government departments,and the virtual establishment of online industry associations,etc.Realistic reasons have led to the frequent occurrence of minors’ rewards for network anchors,which has caused many legal problems,especially minors who concealed their guardians’ huge rewards using their accounts,causing huge economic losses to ordinary families.From the current analysis of minors’ rewarding behavior,there are problems such as obstacles in determining the ability of rewarding behavior,difficulty in dividing the proportion of responsible parties,and difficulty in refunding the amount of rewards on the Internet.These problems urgently need us to solve.Based on this,the article first analyzes and discusses the concept of web-casting,the mode of rewarding,and the nature of rewarding behavior.It is believed that online rewarding behavior should be regarded as a mixed contract,that is,a gift contract under normal circumstances,and a service contract under special circumstances.;Secondly,introduce a large number of real legal judgments,analyze and solve the problems of subject identification,determination of capacity,division of legal responsibilities and refund of rewards in web-casting behaviors of minors;again,from government departments,live broadcast platforms,The industry associations started to explore the deep-seated reasons behind the problem,and found that there are governance gaps in the three parties in the juvenile web-casting.Finally,in response to the above problems,legal suggestions should be made to the juvenile web-caster,and the relevant laws should be improved.Regulations,optimization of law enforcement mechanisms,establishment of guardian responsibilities,etc.regulate minors’ rewarding behavior.
