Research On Legal Issues Of Network Public Opinion Supervision

Public opinions can amplify their positive effects by the Internet,at the same time,it also magnifies the negative effects,such as network rumors,network public opinion violence,network public opinion crimes and so on.To varying degrees,negative effects have infringed on the legitimate rights of the public and undermined the legitimate interests of the public.So,it is very urgent for us to supervise the Internet public opinions in case of the protection to free speech on the Internet of public.While,the imperfect supervision system of whole network in our country has caused many shortcomings in the network public opinion supervision,in addition to the difficulty in meeting the requirements of modern network public opinion supervision by traditional way of speech supervision,the network public opinion supervision in our country has a very long way to go.This paper tries to study the network public opinion supervision in China according to the following five parts.The first part of this article-introduction,from the background of the topic,research significance,literature review,research methods and innovation,respectively introduces the writing basis of the paper.The second part chiefly introduces the basic situation of network public opinion,which mainly includes the specific definition of network public opinion,analysis of the similarities and differences among public sentiment,public opinion and popular will,summary of the characteristics of public opinion in the network environment,and description of the different ways of public opinion communication and supervision.The third part analyzes and studies the basic elements and the legitimacy of the network public opinion supervision.At first,we are sure about the main subjects of supervision,supervision objects,regulatory content,through the analysis of the supervision of the network public opinion which is related to the supervision of the main body,regulatory objects,and the contents of the supervision;Secondly,from the opinions of society,jurisprudence and public opinion,to argue that supervision is necessary to maintain social order and safeguard public rights,it discusses the legitimacy of the network public opinion supervision.Starting from the current situation of China's regulatory system,the fourth part points out the shortcomings of China's regulatory legislation,supervision subjects,supervision mode and supervision procedures and the reasons for those deficiencies.Firstof all,there is a low level and lagging behind in the regulatory legislation;Then the multi-sectoral intervention of the regulatory body causes power cross;Next,reliance on administrative law enforcement of the regulatory model mainly and single regulatory model;Finally,there is lack in legitimacy and legitimacy in the regulatory process.The fifth part is the responses to the above questions.It mainly includes four aspects: First,we should improve the legislative level in the regulatory legislation,pay attention to the development of national basic laws,and build a complete regulatory legal system of network public opinion;Second,we should improve the professionalism the main body,to avoid the decentralization of regulatory power and improve the coordination mechanism between the departments.Third,we should break a dominant regulatory status of the "executive power",emphasize the involvement of social forces,and actively mobilize the enthusiasm of network operators and Internet users;Fourth,we should make up for loopholes in the regulatory process,which introduce legitimate legal procedures to avoid the abuse of regulatory power,and to provide citizens with unimpeded right to relief channels.
