Research On The Communication Mechanism Between The Procuratorial Organs And Network Public Opinion

In the age of Internet, as China’s important legal supervision organs, the procuratorialorgans will definitely face the social public’s attention. In recent years, hot events happen a lot,which repeatedly causes heated comprehensive discussion. Internet users’ massive opinionsabout the procuratorial organs, especially the negative opinions, may seriously weakened thelaw enforcement credibility and law enforcement authority of the procuratorial organs, whichis concentrated reflections of the procuratorial organs taking social trust crisis. In today’ssociety, with the rapid development of network, Internet users take more and more attention tothe procuratorial organs. To stop the hot issues about the procuratorial organs being publicizedby people with malicious intent，reduce public opinion crises happening and improve thepublic trust of procuratorial organs, the procuratorial organs must construct communicationmechanism between procuratorial organs and public opinion. Because of no interrelatedlegislation and theoretical research being in the initial stage, the procuratorial organs alwaysfeel confused and face dilemma of conflict between public opinion and independentlyexercise procuratorial power. Therefore, this paper tries to systematically analyze andsuperficially demonstrate problems given, based on the current situation of communicationbetween public opinion and procuratorial organs and puts forward the elementary issue ofconstruction of communication mechanism between procuratorial organs and public opinion,in order to attract people’s concern on this.In addition to the introduction and conclusion, this paper consists of five parts, totallyabout33,000words. The following is simple generalization of five parts of the content.The first part is an overview, in order to make the reader have a comprehensiveunderstanding of some basic concepts. This paper studies the communication mechanismbetween public opinion and procuratorial organs. So we start from the concept of publicopinion. This paper will define public opinion as the sum total of the most of public people’sconsistently or similar opinions or advice on the specific social problems and phenomenon.After clarifying the concept of the public opinion, with the coming of the Internet Age, theconcept of network public opinion arises at the historic moment. As a kind of public opinion,the network public opinion is the sum total of the most of public people’s consistently orsimilar opinions, advice, beliefs, attitudes, opinions and emotional feeling combined on the specific social problems, phenomenon, government management and social reality, by meansof the internet. The network public opinion on procuratorial organs is the minute concept aftersubdividing the concept of network public opinion, which is the extension to procuratorialorgans. This paper’s study object is network public opinion on procuratorial organs. The firstpart finally discusses the characteristics of network public opinion on procuratorial organs,and the essence of network public opinion on procuratorial organs that are people’s socialsupervision on procuratorial organs.The second part analyzes the current situation of communication between the networkpublic opinion and procuratorial organs in all parts of our country and points out severalexisting problems. With no legislation and practical theoretical research still in beginningstage, so the legislation provisions of social public expressing opinion in the internet almost iscompletely blank, especially on violence and disorder in expression. In practice, someprocuratorial organs have begun to explore building the communication mechanism of thenetwork public opinion and procuratorial organs to change the passive situation theprocuratorial organs face. This part respectively lists ways of communication with networkpublic opinion in the Pudong New Area, Hebe i province and Sichuan province, the city ofBanyan, Linting, Henze People’s procuratorate and so on. The conclusion is: all theprocuratorates take relevant measures and ways. The difference is that they take differentmodes: mainly prevention pattern, mainly guidance pattern and mainly response pattern,finally drawing problems: Inadequately-recognizing the importance of network public opinion;insufficiently-collecting and analyzing of network public opinion; inadequately consciouslycooperate with the Press; backward and single communicating means; shortage ofconstruction of network publicity area.The third part discusses the necessity of strengthen communication of network publicopinion and the procuratorial organs. They are citizen’s right to know, government’s obligationof disclose information,power restricting and the citizen’s supervision, the needs ofimproving the credibility of justice and social justice.The fourth part is the main part of the essay, with the specific system construction ofcommunication mechanism. It includes three parts: setting up network public opinioncollecting, analyzing-warning and responding mechanism. The collection mechanism mainlydiscusses collecting channels, ways and methods. The analyzing-warning mechanism mainlydiscusses the work of analyzing and classifying information before, which is preparing for the subsequent job. The responding mechanism mainly discusses that the procuratorial organsshould make procuratorial work information open to the public. Next is the establishment ofprocuratorial information release mechanism, including replying posts in the forum and microblog, opening up the procuratorial work blog and building news spokesman system. Whenreleasing information, we must notice the time, accuracy of the information and propermanners and need to take all parties ’interests into account. Once again, the procuratorialorgans should establish cooperation mechanism with the Press.The fifth part points out the questions the procuratorial organs must pay attention towhen communicating with the network public opinion. It includes that the procuratorialorgans should change attitudes towards the network public opinion, with open insight to faceit actively, no longer escaping and properly manipulate the dilemma of conflict betweenpublic opinion and independently exercise procuratorial power. Finally the procuratorialorgans must strengthen the construction of team foundation and enhance the publicity oninternet to prevent negative opinions from the source.
