A Study On Anti-domestic Violence:from A Perspective Of Public Security

Domestic violence is a worldwide social problem.In China,domestic violence leads to divorces,personal injuries among children,women and old people,and even serious vicious violence.The public security organ plays an important role in preventing and controlling domestic violence.And this role is irreplaceable.However,the role has long been limited due to the imperfection of the law system and other factors.The implementation of China’s first Anti Domestic Violence Law is of great significance in preventing and controlling domestic violence nationwide.The law makes clear China’sattitude towards any forms of domestic violence,provides a legislative basis for the police interventions in domestic violence and other criminal cases.Yet compared with countries（regions） with relatively perfect legal system,China is still in the initial stage in the prevention and treatment of domestic violence.The mechanism of the public security unit’s intervening in the domestic cases is not systematic and lacks of maneuverability.Meanwhile,the lack of co-operations of multi-disciplinaries in the whole society affects the efficiency of the prevention and control of criminal cases.In Literature Review,the following will be discussed:the current laws and regulations of the public security organs against domestic violence in China;research results of other scholars;practices of domestic violence cases in the United States,The United kingdom,Norway and Taiwan.Then the external factors affecting China’s public security organs’ intervention in domestic violence will be analyzed:the low rate of reporting to the police,the social indifference,the controversy of active interventions in domestic violence,the prevarications caused by unclear responsibility.The internal factors are:the public security organs’ lack of awareness of the harms of domestic violence,lack of personnel,two many non-police activities,unclear handling procedures,lack of specialized agencies and assessment management,lack of evidence-consciousness of investigation personnel.Based on previous research,further studies will be focused on:(1)the establishment of domestic violence investigation and early warning mechanism for the public security organs;(2)the early disposal of the cases;(3)the post-processing;(4)long-term prevention.The responsibility and authority of the public security organs to intervene in domestic violence must be clarified.The rules and procedures of the police handling the cases must be made equally clear.Last,feasible suggestions on the comprehensive prevention and control of domestic violence cases will be given to the public security organs.
