Research On The Causes And Prevention And Control Countermeasures Of Domestic Violence Crime In China

The crime of domestic violence is an illegal and criminal act that occurs between family members,as well as those who have guardianship,fostering,foster care and cohabitation.It not only seriously damages the personal rights and dignity of the victim,but also greatly destroys the stability of marriage and family and social harmony.Six years since the implementation of the Anti-Domestic Violence Law in China,the concept of opposing domestic violence has gradually gained popular support,but domestic violence crimes are still frequent,and many deaths caused by domestic violence are very distressing.Therefore,through the current situation of domestic violence crimes in China in the past three years,this paper summarizes the reasons for the frequent occurrence of domestic violence crimes,and then puts forward targeted suggestions to improve the prevention and control measures of domestic violence crimes according to the actual situation in China.The main content of this paper is divided into four parts:The first part is the overview of domestic violence crime.Domestic violence and domestic violence crime are defined theoretically.Combined with relevant definitions outside the region,the subject scope and violent behavior that should be included in domestic violence regulation in China should be appropriately expanded,and the concept of domestic violence crime is defined by combining criminology and criminal law.At the same time,the types of domestic violence are defined and elaborated according to physical violence,mental violence,sexual violence and economic control violence.The second part analyzes the characteristics of 244 cases of domestic violence in recent three years.Mainly from the characteristics of the subject of crime,the relationship between the subject of crime and the victim,geographical distribution,conviction,litigation methods and other aspects of the summary,for the follow-up domestic violence in China to lay a foundation for in-depth discussion of the causes and solutions.The third part analyzes the reasons for the frequent occurrence of domestic violence crimes.According to the current situation of domestic violence crime,combined with China’s current laws and regulations,judicial practice,mainly from the domestic violence crime prevention mechanism is not perfect,the trial mechanism is defective,the social assistance system is not perfect and so on three aspects.The fourth part is aimed at the reasons for the frequent occurrence of domestic violence crime,from the perspective of the prevention of domestic violence crime in advance,punishment and relief during and after the incident,put forward suggestions to improve the prevention and control countermeasures of domestic violence crime,in order to form a comprehensive prevention and control mechanism.First of all,we should pay attention to the prevention in advance,by giving play to the early intervention role of the public security organs,implementing and using the personal safety protection order,and using the advantages of the Internet to establish a domestic violence file database,so as to avoid the minor domestic violence behavior into domestic violence crime.Secondly,we should pay attention to the punishment and relief during and after the incident,improve the trial system of domestic violence crime,solve the problem of obtaining evidence,reasonably convict and measure the punishment,and realize the purpose of punishment.Finally,it is necessary to establish a comprehensive anti-domestic violence social support system,establish specialized social relief agencies,strengthen the linkage and cooperation of various social organizations,and promote the formation of a long-term mechanism for the prevention and control of domestic violence.At the same time,it is necessary to improve personal awareness of domestic violence prevention and control,establish legal concepts,and resist domestic violence.
