The Application Of Adr In The Export Of Chinese High-speed Railway

ADR(Alternative Dispute Resolution)system,as a dispute resolution system,has been widely used in commercial,trade,construction and many other fields of industry.In recent years,with the development of high-speed rail in China,the ADR system has also been applied in the high-speed rail industry.There are many different modes of ADR system,Chinese high-speed railway’ export applied to several models of them.However,it is not enough for the practice and for the future development.This article stands on the perspective of practice,combing the ADR system which has been applied in Chinese exports of high-speed rail in the project mode,and puts forward suggestions in this situation,makes the introduction of more ADR application mode,improving the system in the high iron export sector.This article is divided into the following parts:the preface describes the author’s research methods(including field interviews,reading literature,etc.)and literature review of the basic situation.The second part,the Mexico high speed rail project as a starting point,taking the investigation result as the basis,the specific situation Chinese high iron export project;the third part,combing the ADR system,compared with the litigation system,introduces characteristics of ADR system,and listed China exports of high-speed rail project status in application the mode of ADR,including FIDIC and negotiation;the fourth part,analysis of the current situation of the application of ADR system Chinese lack of high iron export project,expert system ADR system,arbitration system in high-speed rail project proposals and feasibility analysis;the fifth part,make a conclusion.This paper demonstrates the DAB program and negotiation Chinese high iron export project application of FIDIC contract of the two ADR procedures to safeguard their own interests is not enough,and made the introduction of the International Chamber of Commerce expert system and improve the arbitration system,hope to use more diversified ADR security system,Chinese exports of high-speed rail project.
