Research About Protection Of The Rights And Interests Of High-Speed Railway Passengers

High-speed railway transportation has become an important mode of passenger transportation.Protection of passenger rights and interests is an important issue in high-speed railway transportation.In recent years,there have been some phenomena that infringe upon the rights and interests of passengers,such as the seat occupation,so it is imperative to strengthen the legitimate rights and interests of passengers on high-speed railway..This paper is divided into five chapters.The first chapter is the introduction,focusing on the research status and necessity analysis.The second chapter is " Overview of High-speed Railway Passenger Transport Contract",focusing on explaining what is the high-speed railway passenger transport contract,and analyzing the differences of offer and commitment in the three tickets-purchasing ways among window-order,telephone-order and website-order.The third chapter is " the rights and interests of high-speed railway passengers" which divides the rights and interests of high-speed railway passengers into seven parts: the right to enjoy safe transportation,to arrive on time,to know information,to ensure information security,to enjoy additional services,to terminate the contract and to seek help and claim compensation.The fourth chapter is " Empirical Study on the Protection of High-speed Railway Passengers’ Rights and Interests: Current Situation and Problems" which is mainly based on some actual disputes between passengers and high-speed rail carriers when travelling on high-speed rail.This paper discusses the rights and interests of high-speed railway passengers involved in the two major events that frequently attract social attention,namely "high-speed seat occupation" and "high-speed schedule delay".From the perspective of the parties involved,the passengers violated the creditor’s rights of the passengers.From the perspective of public security,violations of public order should be punished.At the same time,it analyzes the objective problems existing in the protection of passengers’ rights and interests.The fifth chapter is " Suggestions on improving the legal system for the protection of the rights and interests of high-speed rail passengers in our country".First of all,two Suggestions are put forward for the improvement of the legislative system.Then,in view of the above problems,it is suggested that the railway blacklist system should be improved legislatively,the legislative punishment for the seat occupation should be made clear,and the railway credit investigation system should be further improved.Firstly,it puts forward three suggestions on the improvement of the legislative system,and then it puts forward several thoughts on the protection of the rights and interests of passengers from three aspects of credit investigation system,delay compensation system and relief system;Clarifying the compensation system for delays on high-speed trains;Improving relief channels for passengers.
