This thesis attempts to provide arguments for the necessary and sufficient reason of punishment.The author initially argues that wrongdoing is not the necessary and sufficient reason for punishment.In the field of ethics,both of retributivism and consequentialism defend for their own necessary and sufficient reasons.The author indicates that most of criticisms from their opponents are not convincing by discerning retributivism and consequentialism’s corresponding insights on the being of punishment.However,the consequentialism cannot escape from the irrational elements in the deep of free will.Therefore,this thesis abandons the punishment theory of consequentialism and adopts retributivism,which will be combined with the theory of consent. |
