Informed consent is the core concept and basic principles of life ethics,referred to in the process of clinical diagnosis,treatment,the patient has the right to know my illness and medical personnel to take the diagnosis,treatment and prognosis of and costs,and choose the treatment,the patients also includes the basic rights of people with mental disorders.Mental disorders as a social vulnerable groups,the deficiency in the thought and behavior ability,it is difficult to even express their interest demands,combined with the moral foundation of medical informed consent is there are many differences and confusion.It makes informed consent that the implementation of the clinical practice is not ideal,and the implementation of non-standard and inadequate situation is widespread.This will lead to the violation of the autonomy of the mentally disabled and even the physical and mental damage.How to protect the legitimate rights and interests of citizens,especially the right of informed consent of patients with mental disorders,has become an urgent problem to be solved.This article tries from the domestic and foreign existing laws compared in this paper,the necessity and operability of informed consent rights from ethical justification of informed consent right to consolidate its theoretical basis,through the analysis of the ethical conflicts of informed consent the deep-seated problems of mining block its implementation,and finally from the follow a principle and implementation of four ways to promote the further informed consent rights.The aim is to respect the legitimate rights and interests of patients with mental disorders and their families to the maximum extent,increase harmonious factors and reduce inharmonious factors,so as to resolve social contradictions and maintain social stability.
