A Study Of Resolving Medical Disputes Based On People's Meditation

With the increasingly tense doctor-patient conflicts in recent years,the incidence of medical disputes shows a sharp upward trend on the whole.Cases like gathering people to encircle hospitals,smashing medical equipment,pulling banners,setting morgue for mourning,restricting the personal freedom of medical personnel and even assaulting the staff occur frequently and seriously disturb the normal medical order of the hospitals,becoming a major problem affecting social stability.Over the past years,the new mode introducing people's meditation mechanism to resolve medical disputes quietly rises nationwide.As a kind of third-party dispute resolution to eliminate disagreements,people's meditation offers a new way to intervene in the resolution of medical disputes;with its advantages,feasibility and remarkable achievements made in resolving disputes recently,it has fully proved that there is a strong practical need for people's meditation involving in medical disputes resolution.The thesis starts from the working experience of Tianjin Medical People's Mediation Committee in resolving medical disputes over the years of and targets at the necessity and feasibility of people's meditation in resolving medical disputes for studying.Based on the descriptions of the seriousness and urgency of medical disputes nationwide in current stage,the thesis lists three existing ways in handling medical disputes--the doctor-patient negotiation,administrative mediation and technical appraisal and court judgment,and analyzes the advantages and disadvantages of these three ways so to introduce another way of handling medical disputes--people's meditation.The author introduces people's meditation from the aspects of its meaning and functioning and takes the form of cases to analyze the categories of medical disputes,accompanied with a focused study on the medical dispute conditions in Tianjin.Based on relevant information,the thesis summarizes that since the establishment of Tianjin Medical People's Mediation Committee in 2009,its has initially formed a medical dispute disposal mechanism with the medical liability insurance and people's meditation in medical disputes as its two pillar mechanisms through constant practice and innovation.The committee plays a positive role in safeguarding the interests of both parties in medical disputes and maintaining social stability.What's more,the thesis conducts the improved design of the people's meditation scheme in resolving medical disputes according to problems existed in the people's meditation in the Committeeand eventually proposes some countermeasures and suggestions about resolving medical disputes based on people's meditation,so to offer decision-making reference in building a harmonious doctor-patient relationship.
