| Open national soil pollution survey data bulletin in 2014 April, the overall situation of China’s agricultural soil pollution has become more and more serious. People began to attach importance to the agricultural soil pollution prevention and treatment.Combined with the analysis of shortage and weakness of current legislation situation of agricultural soil pollution in China and learning from the experience of developed countries’legal system against the agricultural soil pollution, in order to put forward some useful views and ideas to construct and alter the legal system of agricultural soil pollution.The first part of this paper is to analyze the concept and characteristics of soil pollution, then describe the urgency situation again on the agricultural soil pollution and harm of the agricultural soil pollution legal system construction, laying the foundation for the following.The second part of this paper, firstly is to summarize the history of legislation on soil pollution in China, followed by the presentation of the agricultural soil pollution legislation and law enforcement, the judicial system in China; Finally is to analyze the problems in the agricultural soil pollution prevention exist in legislation, law enforcement, judicial system to establish a clear direction for the construction of the legal system.In the third part, through the introduction of the relevant legal system and law of agricultural soil prevention in Japan, USA, Germany,those with rich experience onthe agricultural soil pollution prevention and treatment, we hope that it can provide some useful advice to structure our country’s agricultural soil pollution law.The fourth part is to construct the legal system of agricultural soil pollution base on the analysis above the three parts, providing the reference foundation and legal system. |
