The Study On Legal System Of Joint Prevention And Control Of Regional Air Pollution

The atmosphere is characterized by integrity,strong liquidity;air pollution is characterized by complex,regional in China.Atmosphere and air pollution of these characteristics make cross--regional joint prevention and control of air pollution has become a necessary measures.Cross--regional joint prevention and control of air pollution at the legislative level has the environmental protection law and the law on the prevention and control of air pollution as the legal basis,legal level with the principles of sustainable development as the theory basis.Chapter one of this article and the second chapter studies the necessity and feasibility of joint prevention and control of air pollution area,the purpose is to prove the laws and regulations,under the premise of legal and policy support,the practice has been going on under the condition of cross--regional joint prevention and control,legal innovation,perfecting the cross zone defense organization reasonably.Through the research field of air pollution domestic and abroad zone in different ways,summed up their respective advantages and disadvantages and what can we draw a lessons from.The third chapter mainly research and comparative analysis of different types,different nature of the cross--regional coalition.Watershed management organization in the field of water pollution,in view of the regional supervision centers nationwide environmental problems,the are of world economic cooperation organization,like the world trade organization;By putting a cross--regional joint prevention and control of air pollution group compared with different properties of cross--regional cooperation organization after analysis,we can be summed up cross--regional cooperation organization essential kernel.Under the support of the reasonable,we can enrich regional extension of joint prevention and control of air pollution.Problem oriented thinking,help us to solve the problem.In the process of regional air pollution control in China,the problems existing in law is too principle,and too specific,refers to cross--regional coalition is too loose,organization is not continuous,members of the organization and the authority,responsibility is not clear,the organization’s sources and usage is uncertain,the organization’s safeguard mechanism is missing.The fourth chapter will focus on specific issues whit specific analysis,in specific legal provisions to solve principled strong and persistent is not strong,the members of a clear organizational functions and powers and prevent inaction and mutual shuffle,special fund is being use in special way,and build up punishment mechanism,design a solution over disputes,so we can establish a long-term running system.
