Analysis Of Project Environmental Impact Assessment Legal System

Since the People’s Republic of China Environmental Impact Assessment Law published, Chinese featuring construction project environmental impact assessment of the legal system has shown signs of scale. But with the increasing in population and all kinds of development of large construction projects, the extent of damage to our environment also keep rising. Today, to build a harmonious society is a common environmental consciousness. And it is also a goal for changing the old patterns between environmental protection and economic development.This paper studies the contents and procedures of the legal system of domestic construction project environmental impact assessment at start, then elaborates the concept and legal evolution of environmental impact assessment of construction projects. By analyzing the case Mao Ming PX project, summarizes the status of the legal system of our construction project environmental impact assessment, and points out the inadequacies sections, for example, not to establish a unified legal norms, lack of alternative legislative content, unsound information disclosed system and social public participation system and so on. I borrowed the scientific experience of the legal system of environmental impact assessment of construction projects in other countries,combined with our existing point of the regulations, proposed a series of legislative proposals.Recommendations presented in this paper, mainly for the main responsibility for the construction project environmental impact assessment, content content, especially alternative system of public participation, environmental assessment agency market,accountability mechanisms, to further clarify the specific problems exist in the existing system and recommend legislative level, including alternative information disclosure system, the system of public participation, environmental assessment agency market and much more, I hope our construction project EIA the legal system in suitable conditions to continue to develop at the same time, taking into account the convenience and efficient, the basic principles of openness, fairness in the system level environmental protection of citizens ’right to know, such as the right to profit. These methods will also promote the environmental protection in China.
