The rapid of economic in our country is developing quickly.But with the economic development environmental problems are gradually revealed.It has serious threat to human life and health,and harm to human’s right.All these can make the basic human rights can not be effective guaranteed.Environmental impact assessment system,as an advance in project planning decision system,is particularly important to prevent pollution.Environmental impact assessment law system originated in the United States.Then,the legal system of environmental impact assessment has been completed and developed for more than 50 years.The introduction of our country is also along for 40 years,but until today,our country’s legal system of environmental impact assessment is one-sided,and there are many defects.Environmental impact assessment object is narrow,lack of public participation rules,alternative regulation is blank,the lagging of legal liability provisions,and the emergence of the environmental impact the assessment.All these are influenced by administrative events prove that the legal system of environmental impact assessment of our country still has a lot of room for improvement,So our country’s legal system of environmental impact assessment must be improved and perfected.In theory research our country’s legal system of environmental impact assessment,etc,from actually consider know the impact of China’s legal system of environmental impact assessment,and reference from foreign experience in advantage,avoid defects,then combining with China’s specific national conditions,then we can give improving suggestions to our country legal system of environmental impact assessment.This article research the legal system of environmental impact assessment in our country.There are five parts in this article..The first part,summarizing the domestic and foreign scholars ’s research on legal problems of environmental impact assessment and research the background and significance of this article.The second part,introducing the related concept of legal system of environmental impact assessment and the environmental impact assessment and also the development history of our country and the whole world.The third part,analysis the present situation of the legal system of environmental impact assessment in our country and the existing problems.The fourth part,do the research of foreign environmental impact assessment law system and the legislative situation,so as to get enlightenment for the legal system of environmental impact assessment in our country.The fifth part,make the comprehensive analysis of the problems existing in the legal system of environmental impact assessment in our country,China’s national conditions,as well as experiences of the foreign legal system of environmental impact assessment,and make the suggestions suitable for China’s national conditions and the present situation and perfecting our country’s legal system of environmental impact assessment.Those are:first,expand the scope of environmental impact evaluation objects;Second,perfect the system of public participation in environmental impact assessment;Third,add the alternative to the eia legal system;Fourth,expand the law responsibility of environmental impact assessment;And the fifth,eia procedures and administrative separation.
