Abstract/Summary:
Based on certain elements of the natural resources is nonrenewable, the development of environmental situation is showing a trend, irreversible condition. In economic structure shift its growth at the same time, the environmental resources of input and output changes are indelible influence to human survival environment. The purpose of developing environmental impact assessment system in China is to estimate risk, nip in the bud, but the system in practice has been a state of high cost of low efficiency. This article will combine the sustainable development theory and the legal cost benefit theory, from the analysis of problem of this system in our country put forward countermeasures of perfecting our country’s legal system of environmental impact assessment, so as to improve the effectiveness of the environmental impact assessment system in China.The paper is divided into four parts, the first chapter from the definition of environmental impact assessment analysis function and significance of environmental impact assessment, environmental impact assessment system from the United States the development process of analysis of the development of this system in our country.The second part mainly from the basic principles of environmental impact assessment,evaluation objects as well as the evaluation process from three aspects this paper introduces the basic contents of environmental impact assessment system in China.The second chapter analyzes the environmental impact assessment of two basis theoretical: the sustainable development theory and legal cost efficiency theory, the further interpretation of the environmental impact assessment system applied to the development of two theories. The third chapter of environmental impact assessment in China basin form on a single object, operation and EIA lack independence and impartiality, imperfect legal supervision four aspects analyzes the Chapter IV for theabove four aspects put forward concrete Suggestions of perfecting our country’s environmental impact assessment system, so as to solve our country legislation cost higher than the cost of illegal.
