| Environmental and resource issues are the common concern in world today.Exploitation of mineral resources is like double-edged sword.On the one hand,mineral resources could promote economic development,but on the other hand,it’ll destroy the local ecological environment.Tibet is rich in mineral resources and it is an vital ecological buffer area The frangibility of its ecological environment decided that the urgency and necessity to protect the ecological environment of the mining area in Tibet.Although China had published a serious of laws ad regulations relevant to environment protection,there are still no specific legislation to solve the environmental problems caused by mining development.Since the problem of decentralized legislation,loose enforcement,unsound judicial,etc,leading the inadequate protection of mining area and indistinct efficiency.Based on this background,this paper will introduce the ecological environmental situation and existed problems at present of Tibet.Comparing the mining area environmental management systems and legal system of the western countries,such as USA,Australia and Canada.Try to explore the issues exist in law construction of Tibet from three aspects which are legislation,execution and justice.Furthermore promoting some matching inspiration and suggestions to improve laws of mining environmental protection in Tibet,and make a contribution to the Tibetan ecological security barrier construction. |
