Study On The Responsibility System Of Ecological Restoration In Mining Areas In China

Implementing the legal responsibility for ecological restoration in mining areas can not only restore the ecological environment of mining areas,but also balance the economic value of mining areas,and ultimately realize a new pattern of mineral development in which development and protection are coordinated.This article specifically combines the current system and practice of ecological restoration and management in mining areas in China,based on the difficulties faced by the ecological restoration system in mining areas in China,starting from the actual needs of the government,the mining right holders and the surrounding people in the ecological restoration areas of mining areas,and starting from the particularity of the legal liability for ecological restoration in mining areas,preliminarily discusses the system construction of ecological restoration in mining areas in China,so as to promote the implementation of the legal liability for ecological restoration in mining areas in China.Starting from the theoretical contents of legal liability for ecological restoration in mining areas,this paper studies the concepts of ecological restoration and legal liability for ecological restoration in mining areas,analyzes the theoretical basis behind the responsibility system for ecological restoration in mining areas,and analyzes the components of legal liability for ecological restoration in mining areas,so as to make theoretical preparations for the study of legal liability for ecological restoration in mining areas;Then,the current situation and problems of the responsibility system for ecological restoration in mining areas in China are investigated,the necessity and particularity of constructing the responsibility system for ecological restoration in mining areas are analyzed,the laws,regulations and policy documents implemented in the field of ecological restoration in mining areas in China are sorted out,and the practice of ecological restoration in mining areas is investigated.In light of the above circumstances,the existing problems of the responsibility system for ecological restoration in mining areas in China are mainly clarified;In addition,the implementation experience of the responsibility system for ecological restoration of mining areas in foreign countries is summarized through investigation,and the international experience with local value is summarized from the national conditions of China;Finally,suggestions are made for the construction of the responsibility system for ecological restoration in mining areas in China,the basic principles of the responsibility system for ecological restoration in mining areas are clearly defined,the main body of the responsibility for ecological restoration in mining areas is determined,a unified standard for the responsibility of ecological restoration in mining areas is established,the management of funds for ecological restoration in mining areas is guaranteed,and the supervision of ecological restoration in mining areas is strengthened,so that the legal responsibility for ecological restoration in mining areas is implemented.
