Research On The Legal System For Ecological Compensation Of Air Quality

In recent years, air pollution has been a very serious problem and the air quality is becoming increasingly worse in our country. In order to improve the air quality and make up for the limitations of air pollution prevention and control work, many provinces in our country have formulated and implemented the legal system for ecological compensation of air quality and carried out practical explorations for ecological compensation of atmospheric eco-environment, which have made some achievements. However, the present legal system for ecological compensation of air quality is incomplete and still has some problems. These problems restricted the effective implementation of this legal system, obstructing the progress of protecting the atmospheric eco-environment. So, it is the primary content of this thesis to study how to improve the the legal system for ecological compensation of air quality. And this thesis can be divided into four parts to research this legal system.The first part is overview of the ecological compensation of air quality. First, it defines the concept of the ecological compensation of air quality. Then, it examines the special properties of atmospheric ecosystem, concluding the specificity of the ecological compensation of air quality. At last, it summarizes and analyzes the practical significance of building the mechanism of air quality ecological compensation. From the above three aspects, this part discusses the relevant theory of ecological compensation of air quality.The second part is a introduction to current situation of the legal system for ecological compensation of air quality in our country. It combs the present situation of this legal system from two levels: national legislation and local legislation and highlights the local legislation practice for the ecological compensation of air quality.The third part analyzes the problems existing in the current legal system for ecological compensation of air quality in our country. It clarifies these problems from three aspects: the disorder of the legal system for ecological compensation of air quality; the imperfection of the system content and the implementation guarantee mechanism.The fourth part expounds the improvement of the legal system for ecological compensation of air quality. This part corresponds to the problems existing in the legal system for ecological compensation of air quality and proposes reasonable suggestions for the improvement of the legal system for ecological compensation of air quality from three aspects of strengthening the legislation of air quality ecological compensation, improving the system contents and building up a sound implementation guarantee mechanism.
