The Research On Marine Environmental Pollution Ecological Compensation System

In total, the world ocean is about360million square kilometers, accounting for about71%of the surface of the earth. The marine environment that includes ocean surface, ocean water and oceanic livings is crucial to human survival and development. However, with the widening of human activities range and the increasing of human activities frequency, the marine environment pollution events take place continuously. The marine ecological environment suffers from the pollution of human activities, and the stability of the marine environmental ecological system is under serious threat.Establishing a scientific marine environment ecological damage compensation system, strengthening the protection of the marine ecosystem, making a scientific and reasonable development and utilization for the sea for, and only this can we realize the sustainable development of human health.The development and utilization of the sea starts late in our country, and whether the marine pollution control or the construction of ecological compensation system are both in backward level. As more and more countries take the exploitation and protection of the ocean as their national development strategy, this paper discusses the marine environment pollution ecological compensation system.At first, this paper defines the marine environment pollution ecological damage with content analysis, introduces the different definitions from the ecology and legal by scholars, and summarizes the causes and consequences of marine ecological pollution. Then, the United States and Japan which have successfully implemented the marine ecological compensation for damage are introduced with comparative analysis, and there two factors for their successful implementation of the ecological damage compensation namely are the implementation of the environmental public litigation system and establishing professional evaluation institution for ecological damage compensation, our country can learn the related experience. Although our country have published a number of laws and regulations to protect the environment and natural resources, but there is still no established marine ecological compensation system. Finally the paper analyzes the problems exposed in the practice of ecological compensation system, and proposes some relevant advice to perfect our country’s ecological compensation system.
