Study On The Legal System Of Soil Pollution Risk Assessment

With the high speed development of economy and high-tech industries,China is facing more and more serious problems in soil pollution,because the innovation of science and technology,causes the negative influence on soil pollution,unknown and uncertainty.At the same time accompany with the soil pollution risk assessment system,compared with the traditional environmental problems in terms of the risk assessment system has the profession of uncertainty and its own characteristics need to be strong.Some scholars predict that in the near future,with the further development of science and technology and society,soil pollution risk assessment will become the main theme of soil conservation.However,in our country the national level legislation,national legislation related to soil pollution risk assessment system has just started,only in 2016 the Ministry of environmental protection pollution "soil environmental management measures(Trial)" the provisions made,and only in extremely limited land pollution do a few about soil pollution risk assessment and management the sporadic,general provisions.Failure to assess the basic principles of the system,the formation of a complete and systematic system.To assess the risk of soil pollution is a very strong professional color system,involves many disciplines and across different areas;source of contaminated soil is broad,covering a large range,land types and the complexity of the field of system construction has become a very difficult task.And based on the above situation,aimed at the establishment of China’s soil pollution risk assessment of the legal system,from the basic principles,evaluation subject and scope,detail assessment procedures and the evaluation of the effectiveness of the five aspects.The basic principles include: the principle of legal assessment,the principle of independent evaluation,the principle of comprehensive and objective evaluation and the principle of procedural justice.Evaluation of the main administrative and land use rights.Assessment procedures include: identification-Evaluation-management.The effectiveness of evaluation is related to theeffectiveness of the administrative organ,the effectiveness of the right to the use of the land,the effectiveness of the third party and the effectiveness of the public.The scope of the assessment is the type of specific land,activities and related substances are assessed.To sum up,I hope this paper can provide more constructive comments on the legal system of soil pollution risk assessment in China,so as to achieve the purpose of protecting human health and ecological security in China.
