Research On The Legal Problem Of Marine Pollution Prevention

The development of economy and the increase of population urge people to expand other resources expect land in order to alleviate the pressure of the population. The vast and resourceful marine has become a new area and power to keep sustainable development of human society and to help humans go out of resource shortage. In recent years, the Marine environment pollution is increasingly serious, to protect the Marine environment has become unanimous consensus. While our country has issued regulations to manage it,the result is not satisfactory. The 21 st century is Marine century, all countries trying to seek new way for the sustainable development of ocean.First of all, through describing the situation of Marine environment pollution, the article points out the seriousness and urgency of Marine environment government.Secondly, through describing the classification of the Marine environment pollution controlling legislation system, the article concludes the existence of the following questions;the lack of ocean legislation updating, the legislative blank; Marine environment pollution control regulations are too principled, lack operability; Lack of civil legal liability and regulations imperfect in public participation system. This paper introduces the present situation and the meaning of the law enforcement after the reform, pointing out that the reform of law enforcement needs to solve three key problems: relations of Marine departments need to be further coordinated; Marine related laws and regulations as well as the equipment need to be modified or improved. Finally, the article points out advice aiming at solving the existing problems.
