International maritime oil leak-prone, beginning from the US Gulf of Mexico drilling platform accident, oil spill Korea Tai’an, China’s Dalian oil pipeline explosion and fire, Penglai 19-3 oil spill, and many other due to collision of ships at sea, offshore drilling platforms leak causes overflow oil accident catastrophe for humanity. Improvement of maritime oil pollution prevention laws and regulations, the establishment of oil spill prevention and control system, is imminent.China and South Korea are separated by a sea maritime country, both countries faced a series of problems and prevention of marine pollution oil pollution at sea, these problems not only to China and South Korea as well as their ecological impact of economic prosperity, but also has a common waters-Yellow Sea neighbors cause interference. In order to strengthen mutual cooperation to effectively deal with the oil spill disaster together, the two countries signed the "Pacific Northwest oil spill contingency plan," "South Korea Maritime Search and Rescue Cooperation Agreement", etc., which are beneficial to China and South Korea on marine oil spill prevention and treatment outcome of cooperation. South Korean marine environment norms of governance than China started early, so there is a lot of experience in the legal aspects of maritime oil pollution prevention is worth China to learn from. Through bilateral maritime legal issues related to oil pollution prevention research, marine oil spill further strengthen substantive cooperation for China and South Korea to provide a reference.Through a comprehensive analysis of the offshore oil spill, offshore oil sources and hanm done a detailed description, and laid the foundation for the study of offshore oil spill. China and South Korea at the same time the practice of law on prevention and control of marine oil spills summarize, compare. Including:the relevant international conventions, China and South Korea as well as comparison of the two legislative practice of marine oil spills. Comparison, Korea legislation better, made special legislation for pollution prevention; our law on prevention and control of oil, scattered in various laws and regulations, not the system, in the judicial practice of conflict prone. In the specific case for China and South Korea on offshore oil-depth analysis of judicial practice. Our emergency system is not perfect, information disclosure is not fast; Korea can quickly establish emergency disaster prevention system, and the high degree of public participation. Through the above analysis of China’s marine oil spill prevention and legal mechanisms of marine oil spill prevention and control system and Korea were compared, the author proposes a sound legal system of China’s offshore oil pollution prevention and strengthen their prevention and control of oil on the sea from two angles legislation, law enforcement recommend regard. First of all, our country can learn from Korea introduced specific legislation relating to the oil spill compensation fund at the same time improve our system and mandatory insurance system. Secondly, the establishment of a unified system of maritime law enforcement to improve our emergency response system. Finally, to strengthen bilateral cooperation in the prevention and treatment of South Korea call on oil-absorbing the advanced experience of other countries and common development.
