Legal Research On Marine Oil Pollution Prevention

With the rapid development of shipping industry and the expandingscale of offshore oil exploration, the probability of oil spill accidentsoccurred in our sea area greatly increases. A large amount of oil spillnot only seriously harms the marine ecological environment, but alsocauses huge economic losses. Although the legal system of marine oilpollution prevention in China has been basically established, but thereare all kinds of problems to be solved in the future.My thesis starts with the severe situation of marine oil pollutionprevention, and then analyses the legislation of marine oil pollutionprevention so as to find the existing problems in the field of legislation.With the legislative experience afforded by developed countries, renderssuggestions. My thesis is divided into four parts.The first part of my thesis describes the overall situation of marineoil pollution. First of all, the precise definition of marine oilpollution is given, and then the comprehensive analysis of thecharacteristics of marine oil pollution illustrates the source and theharmfulness. And the oil spill accidents and the current situation ofmarine oil pollution in China let us fully realize the importance ofstrengthening marine oil pollution prevention.The second part analyzes the legislation of marine oil pollutionprevention in China in detail. And it points out that China doesn’t legislate oil pollution prevention and some legal regulations obviouslylag behind the development of society. Meanwhile, it also discuss somedefects in the legal system of marine oil pollution prevention and pointsout that it is necessary to conduct integrative management in ocean areas. The third part studies the legislation of marine oil pollutionprevention in China Taiwan Province and in western countries. And thecomparative analysis between1990Oil Pollution Act and interrelatedregulations in China laws may afford inspiration for the legislationperfection of China.Based on the research above, the fourth part proposes perfection tothe legal system of marine oil pollution prevention in the fields ofspecial legislation, legal institutions, the construction of marine lawenforcement system. And it can help to improve marine oil pollutionprevention.
