Study On The Protection Of Geographical Indications Of Heilongjiang Agricultural Products

The protection system of geographical indications of characteristic agricultural products in China started relatively late. In the 1980 s, the relevant state departments began to formulate relevant rules for geographical indications protection system. In recent years, the government increasingly recognized the importance of the protection system of geographical indications for our country whose intellectual property legal system is not sound. Also, it recognized that as a traditional agricultural country, there are huge potential geographical indications resources of agricultural products. Heilongjiang Province is located in the center of a typical cold black land. Due to geographical factors and differences between cultural traditions, there are plenty of primary products and subsidiary agricultural products. During the development process of Heilongjiang agricultural products, geographical indications protection system has a significant role in promoting economic development.In the original legal and regulatory framework of geographical indications protection of agricultural products, the Industiral and Commercial Bureau of Heilongjiang Province continued to adopt detailed management rules, and increased the geographical indications protection of Heilongjiang province characteristic agricultural products. The Industiral and Commercial Bureau, the Quality Supervision Bureau of Heilongjiang Province, and other agricultural relevant departments clarify their respective management registration responsibilities, initially formed a breeding methods of geographical indications products. In order to improve the success rate of declaration of geographical indications of agricultural products, it should execute strictly according to requirements, and select the appropriate manner to ensure the advantage of unique quality. Through a variety of ways of propaganda, such as news, newspapers and broadcast, most companies change from seeing to learning the geographical indications actively. Some farmers come to realize that it can bring them great benefits through geographical indications. Due to the lack of protection awareness for geographical indications, the abuse and counterfeiting of geographical indications has negative impact on the economic benefits and market reputation.This paper uses research methods of comparative study, induction and summarization, and has the geographical indications protection of Heilongjiang province characteristic agricultural products as the reseach object. It analyses the present situation of geographical indications protection of Heilongjiang province characteristic agricultural products, and reveals many problems, for example, there are not enough means of protection, the legal system is not perfect, there is lack of regulatory coordination and weak enforcement of quality standards, the phenomenon of counterfeiting is common, brand development is not enough, and it lacks brand creation. It also analyses the reasons of the above problems, such as the inadequate laws and regulations, lack of supervision from government and manufacturer, and inadequate protection awareness of farmers. Considering the abroad experience of protection of geographical indications of agricultural products, this paper proposes solutions, such as improving relavant legislation, enhancing system protection, unifing supervision, clearing responsibility and authority, improving farmers’ quality, and enhancing the protection awareness, strengthening the government’s responsibility, strengthening market supervision and intensifying propaganda. It provides the reference and support for the development of relevant policies, improvement of relevant agricultural laws and regulations, enhancenment of agricultural products competitiveness, solving ’Three Rural Issues ’, realization of regional development of agriculture, protection of natural resources and traditional cultural heritage, and the realization of agricultural Industrialization.
