Land system as a basic system in the development of human society, is not only related to the more beneficial to the people’s livelihood, determines the development level of a country in a certain stage of productive forces. China’s land system according to different regions divided simply into two aspects of rural and city. Land system as the top design of productivity development, the two work together to realize the coordinated development of the two. Undeniable, the early rural land system has played a very active role in motivating the enthusiasm of farmers, get rid of "the disadvantages brought about by the mess", but with the development of the times, has become the key of current rural productivity restricts the further development of the factors.The realization of the use of land intensive use efficiency can effectively increase the unit of land, realize the transformation from traditional agriculture to modern agriculture. Modern agriculture depends on the scale of the operation and management, but the existing rural land circulation and transfer system has become a constraining the development of modern agriculture in the way of. Therefore, all the local practical situation based on carrying out various forms of change, promoted the development of rural land circulation, but also gradually revealed some problems, so the government through the establishment of the system of land property rights system, which makes the rural land circulation in the specification to accelerate. Eighteen party 3 in plenary meeting puts forward "speeding up the construction of a new system of agricultural operation, encourage rural cooperative economic development, support the development of large-scale, specialization, modern management", this shows that the central is positive to the circulation of rural land. The current rural land circulation in the aspects of scale, form etc. compared initially have a qualitative leap.The current mainstream view in Xiaogangcun in 1978 Fengyang County contract households based on the household contract responsibility system has laid the foundation of China’s current rural land system. Therefore, research on rural land circulation, cannot leave to explore 1978 of this point in time, but also to find by hard and thorough search. In this paper, by Marx’s property right theory as the guide, and learn from the transaction cost theory and institutional change theory, for the current rural land system, rural land property rights function design, present situation of rural land property rights effectively analysis. Through the analysis we conclude that the four problems in the current rural land system of the prominent presence, one is the main body of rural land property right is not clear, the lack of incentive and restraint mechanism; two is the land property right is peer to peer and urban and rural land market is fragmented; three is the rural land property right can be lost; four is the rural land ownership is not the lack of implementation specification mechanism. Because of the existence of these problems, rural land circulation today has entered a bottleneck period, reform is urgent.In order to solve this kind of problems, we need to be arranged on basis of analysis on rural land, construct effective coping thoughts. One is to persist in the collective ownership of rural land to establish the modern property rights system; two is to make clear of rural land ownership; the three is the realization and protection to promote the rural land property rights. The idea as a guide, through the unified and perfect relevant laws and regulations, strengthen planning and management, land use control, the reform of income distribution mechanism; effective measures of establishing the revenue return mechanism, improve the relevant supporting reforms such as the integration of the four, is to properly solve the existing problems in the rural land circulation, with reasonable land system to promote the transfer of rural land in our country, more orderly transfer.
