Research On The Questions Of Land Use Rights Transfer In China

Land is the material conditions of human existence, and is also the most fundamental means of production in agriculture. Just as William Petty says:"Labor is father of wealth and land is mother of wealth. " Meanwhile, the land is also a direct object and a key factor that solves the problem of "agriculture, rural areas and farmers". Therefore, it is crucial to research and solve the problem of farmland.The household contract responsibility system in China caused the sporadic division of land and hindered the scale of modern agriculture and the technical progress. However, the land use rights transfer can relieve the current situation of land which has been divided too small, and can improve the efficiency in the use of farmland resources. At the same time, under the premise of protecting farmers' interests, reasonable and formal farmland use rights transfer is an effective way to achieve the scale management of farmland. Obviously, it will be our rational choice to establish and improve the farmland use rights transfer system. This article first analyzed background of farmland use rights transfer, and reviewed the research results of related literature, and pointed out the objective necessity and practical importance of farmland use rights transfer in China. Then on our current situation, I analyzed the characteristics of farmland use rights transfer, including the main forms, driving forces and mechanism etc, and also analyzed the factors that impacted the China's farmland use rights transfer, then pointed out the key problem was how to settle the contradictions between land scale and farmers' interests, that was to promote farmland transfer beneath the farmers' interests. Practical experience showed that only we ensured the farmers' interests, we can make farmland use rights transfer successfully and realize the scale of agricultural operations preferably. Based on the analysis of driving forces and mechanism, the article revealed the main problems and their causes, and used the related experience lesson of developed and developing countries, linking with the practice of China, the article proposed the policy recommendations to establish and improve farmland use rights transfer.
