With the developed of the knowledge economy era, intellectual property has become the focus of attention when the countries in the world conducting foreign trade. From a legal point of view, Intellectual property is somebody who researched of a subject on the innovation of the scientific research achievements so he can achieve the ownership of the performance. From an economic point of view, intellectual property can be understood as a kind of intangible intellectual property, provide a competitive advantage for companies in the international competition, it is a powerful means of international competition. From the1980s our country began to gradually establish a system of intellectual property protection Thus far, China’s intellectual property protection system is still not perfect. With the developed of China’s export trade, China has occupied a certain position in the world, many countries fear in China will soon become the world’s major powers, for this fact many countries desire by intellectual property barriers to trade to create obstacles for China’s export trade in this way. And because of the importance of intellectual property rights around the world, making the rise of intellectual property protection of the boom in the world, and our country is bound to follow the development of the times to make efforts to adapt to changes in the environment.Firstly, this article use the basic concepts of international laws and intellectual property protection of intellectual property rights of a simple presentation and analysis between intellectual property and export trade relations through the basic theory of international trade. Is easy to see that intellectual property is impact China’s export trade from all angles, and these effects can be divided into positive and negative aspects. Not hard to see that the change of the environment of intellectual property protection is conducive to China’s enterprises to improve awareness of intellectual property protection, with the developed of enterprise awareness will have a positive impact for the company’s technology innovation. And when China’s IPR protection environment gradually improved, many outstanding enterprises in developed countries will choose to invest in our country, for our country’s economic growth and trade development will play a catalytic role. However, the world continues to strengthen IPR protection, will also have a lot of adverse effects. Because of our ability to innovate technology is still relatively limited, when strengthen IPR protection, to a certain extent, will increase the cost of China’s export products, thereby reducing product competitiveness in the world market, as the same time, it will impact of the development of China’s export trade. Therefore, in order to solve the currently facing problems for our country, we use an empirical analysis and comparison of the relevant data by listing the data to demonstrate the relationship between intellectual property and China’s export trade, and draws factors affecting China’s export trade, which found the problem of China’s exports Trade in adapting to the presence of environmental of intellectual property protection issues, eventually based on the problems propose concrete solutions.Currently, many study the relationship between intellectual property protection and export trade literature through theoretical analysis. However, this article uses the method of empirical analysis. Eventually come out that the protection of intellectual property and export trade exist of a strong positive correlation. Therefore, Chinese enterprises should actively adapt to the international intellectual property protection environment, and to find a new path of development for China’s export trade.
