Research On Intellectual Property Protection In China’s Export Trade

With the in-depth development of economic globalization and knowledge economy, intellectual property has increasingly become the country’s strategic resources and core elements of international competition, becoming the powerful support for building an innovation-oriented country and the key to master development initiative, becoming the key booster for the development of the modern economy.At present, the issue of intellectual property rights has become one of the focus areas of bilateral economic and trade issues.After the2008global economic crisis, major developed countries in order to restore their economies, have adopted a trade protectionist strategy, and the most important means of protection is intellectual property. Intellectual property protection has become an excuse for developed countries to stop Chinese exporting, and abusing intellectual property protection to prosecute violations of Chinese export. Particularly, United States section337investigation makes China’s export enterprises heavy losses. Our export products are often labeled as infringement. The reason is the lack of intellectual property protection consciousness of Chinese export enterprises. Therefore, China’s export enterprises have an urgent need to strengthen the protection of intellectual property rights, to protect their shares of the international market and the legitimate rights and interests from being infringed.Facing the new situation of economic globalization and the development of international protection of intellectual property, particularly after China’s accession to the WTO, China will achieve economic integration with the world economy, therefore, China is facing enormous pressures and challenges for intellectual property. Whereas, China should carefully analyze the current emergency situation in the field of protection of intellectual property rights, strengthening intellectual property protection. This article is from the perspective of strengthening China’s intellectual property rights. Firstly, it introduces the theoretical basis of intellectual property protection, and then focuses on analyzing the status and the problems of China’s IPR protection, as well as, introducing the Japanese and American experience in protection of intellectual property rights, and the impact of intellectual property protection on our country’s export trade.Through the analysis of these issues,we can summarize a number of policies and recommendations to strengthen the protection of intellectual property rights.These policies and recommendations can help China’s foreign trade enterprises to make better use of their intellectual property rights.These enterprises can adopt a series of measures to strengthen the protection of intellectual property rights and improve capability of independent innovation and enhance international competitiveness. While it makes the country form a comparative advantage in knowledge resources, thereby contributing to economic development and technological progress of the nation as a whole.The analysis of strengthening intellectual property protection in China’s export trade not only has theoretical significance, but also a strong guiding role for China’s export trade and the sustainable development of the country.This article has a deep study on the issue of intellectual property rights in the export trade, through the combination of international trade, microeconomics, property economics, law and other disciplines, combination of theoretical research and practical study, developed and developing countries, the international and domestic levels.Main research contents are as follows:The first chapter introduces the background and significance, and reviews the relevant literature in this field, while introducing the research idea, framework, contents, methods and innovations. The second chapter focuses on the theoretical foundation of intellectual property protection, mainly from the angle of Economics and trade, introducing the related theory, theories of Economics including externality theory, transaction cost economics, endogenous growth theory; trade theories including the theory of comparative advantage and competitive advantage, product life-cycle theory, intellectual property advantage. The third chapter has more comprehensive analysis of intellectual property protection in China’s foreign trade development.This chapter focuses on the achievements of enterprise’s intellectual property right protection, and the problems and difficulties currently facing. The fourth chapter focuses on the relationship between intellectual property protection and China’s export trade, and the impact of the former on the latter, including positive and negative aspects.The fifth chapter presents countermeasures and recommendations to strengthen the protection of intellectual property from both government and enterprise levels.Through this study on China’s export enterprises in the international protection of intellectual property rights,we have a comprehensive understanding of the problem. Through the export achievements and problem analysis of enterprise’s intellectual property right protection, export-oriented enterprises are more aware of the importance of intellectual property protection. Through the influence of intellectual property protection on export trade, we recognize that intellectual property protection is a double-edged sword, so we have to seek advantages and avoid disadvantages.We must adequately take advantage of intellectual property protection to advance the development of the import and export trade, to promote export product structure, so as to promote China’s sustained and rapid economic development.
