An Analysis Of Corruption And Its Corresponding Solution On Land Use Right Transaction In China

Nowadays, corruption problem affects the world’s social and economic development. Some of the countries and regions are facing various serious consequences such as violent social turbulence or even collapse of government, caused by corruption. Since the reform and opening up in the80s, Chinese economic has been experiencing accelerated development. However, due to the highly imperfect legal system, insufficient supervision of officials’behavior and over-concentrated power of the government, our country is one of the nations that are suffering from server corruption. Among the various types of problems caused by corruption, the corruption of land area stands out. Each year our country suffers tremendous economic loses, with multiple occurrences of mass disturbances because of the popularity of power rent-seeking during the process of use right transaction of land.To further facilitate to the tackling of the corruption problem in land area, with a typical case of land corruption as the object of my study and research, I try to conduct an integrated research on the public power corruption in the area of land use right transaction based on current research results and experiences.In the first part the research background and its significance, the main content, key points, difficult points and method adopted in my research will be introduced. In the second part I will explain some of the concepts and the methods that are involved or referred in the content. In the third part I take several cases that happened in H province as the object of my study and research, to illustrate the traits of corruption during the process of land use right allocation, resumption, expropriation and remising. In the fourth part I will further analyze the referred cases with Rent seeking theory, systematical prevention theory, theory of cost-income and zero tolerance theory, to provide subjective and objective causes for this type of corruption. Based on these four parts above and combined with advanced experiences of some regions in China, in the fifth part I will provide suggestions and advice, to further enrich the findings of the researches and studies in this area in our country.
