Research On Formation Process And Influence Factors Of Pasteur- Type Patent

In the context of increasingly global knowledge competition, China is actively adjusting the intellectual property strategy to build an innovative country, especially with particular emphasis on nurturing important patents which play fundamental roles in technological development and industrial innovation. As a field wealth of scientific theories and technological principles, basic research is the important foundation soil for the cultivation of basic invention patents. Scientists have long-term studies to prove the importance and the possibility of basic technology as the output of basic research, pointing out that one of their results is technological invention which is based on science. However, another kind of basic research result triggered by the application, still needs pending further study.Based on review of basic research theories, this article takes Pasteur’s brewing beer patent as the typical case, and analyzes its technical points and ideological source. We names the gather of patents with the same characteristics the "Pasteur-type patent". In addition, this paper selects transistor patent and streptomycin patent as the similar cases from data of the National Inventors Hall of Fame, to further describe the background and the technical ideas of inventions. Case analysis is carried on with the help of references and theories.The study finds that Pasteur-type patent is derived from major scientific discoveries and major theoretical breakthroughs, and formed in technological science. The formation follows the following procedure:Based on certain application purposes or future prospects, in the course of conducting basic research, scientists obtain new scientific discoveries and knowledge, from which they sum up the scientific principles, and on the basis of the principles they get new technological principles. Combined with manufacture requirements and practice demands, after coming up with viable technical plan, patents with strong innovativeness can finally be produced. By means of theoretical analysis, it can be found that during the formation of the Pasteur-type patent, in addition to the guidance of practical purposes, the impact of science and technology, the subjective initiative of inventor, and the matching of social factors also means a lot. Due to the direct and strong role in promoting the effective operation from basic research to industrial innovation, the culture of Pasteur-type patent is worth of the common concern of the government, enterprises and research institutes.
