| Nowadays, technological innovation is important for firms to gain competitiveadvantage. With the rapid development of technological innovation and globalintegration, competition between high-tech industries has been evolved into thebattle of patents from the battle of a single firm, and then escalated to the battleof patents pool. Therefore, to participate in the high-tech enterprises’ patent pool, thefirms can find new ideas to seek survival and development through it. But most ofChinese firms weak in forming patent pool and lack of awareness of independentinnovation. Therefore, the research of the patents structure influence the form ofpatent pool is of great significance for improving our international competitiveadvantage.In the formation of the high-tech industry patent pool, the key is to set up apatent pool successfully which relying on advanced technology standards. Patent poolis a collection of patents; the formation of each pool is often closely related to itspatents. In view of this, we propose a mechanism that the structure of the patentowners and patent references influence the formation of patent pool. In the field ofpatent pools, we take MPEG-2patent pool for study. Firstly, in the high-tech industrypatent pool, vertically integrated companies are more inclined to join the pool thanpure authorized in order to obtain cost savings advantage and economic benefits.Secondly, based on social network theory, reference to the relationship between patentcitations, a patent pool exist closely patentee relationships; patent pool existsauthoritative enterprise harmonize the citations of patents, and thus they coordinateand control the patent pool. Finally, based on the theory and case studies, this paperpresents that authoritative enterprises are encouraged to lead the formation of patentpools; we encouraged to form high-tech patent pools which rely on technicalstandards; government should promote the formation of patent pool which contain alarge number of Chinese patents. |
