Innovation Of Big Data And Investigation Methodology

With the wide application of the third scientific and technological revolution,which is marked by information technology and further development of network communication technology, all kinds of data information is on the exponential trend of rapid multiplication. The era of big data has promoted the social development and change, for traditional investigation methods, based on the small data generation background featuring the theory of static type, management type, solid type, sample type, is difficult to adapt to the new features of new era crimes. The party’s Fourth Plenary Session proposed that "justice is the lifeline" to strengthen the judicial protection of human rights and has made scientific deployment. It is an important statutory duty for two state investigation sessions and the relevant departments to identify case, punish criminals and maintain fairness and justice. Currently it is a major fundamental challenge faced by the traditional investigation methodology to do a good job under the new situation, practice strict norms of law enforcement in case handling, implement the dignity and authority of national law, and maintain the legitimate rights and interests of social fairness and justice and the masses. Besides, it is important to actively explore big data investigation method, ensure the implementation of national laws, and safeguard social fairness and justice,This paper summarizes the main research achievements of big data at home and abroad. It also includes the frontier research methods of investigation in order to explore in depth the philosophical origin of data. What’s more, it explores the relationship between number and development of science and technology, and compares the characteristics of small data investigation methodology with the big data approach in terms of the innovation of investigation method. Facts of the case are the basic task of criminal investigation and the big data provides the possibility of the mining and prediction of philosophical relationship between data and facts. The thesis discusses how to realize way of practicing big data on the basis of scientific cognition. Science and technology is a double-edged sword, so as a new stage of the information technology revolution big data is no exception. By summing up the ethics spirit of big data around the investigation work, and maintaining fairness of civil legal interest as two major tasks, the thesis analyzes the specification of data investigation, the fair maintenance, protection of the philosophical relationship of interests, and puts forward the ways to realize data protection law from the Perspective of interest ethics. A summary of this thesis research and the prospects of big data in the investigation are finally discussed.
